其实有两个人,另外一个白人小孩也没停住朝屋主走反而都没事,但是日本被打死了。 也就是说我说的,因为那里附近亚裔少,所以屋主以为是陌生人,所以才开枪。

呃,说了半天,没有一个是亚裔踩草皮被打枪的但屋主被acquit的。 美国枪支泛滥,谁都知道。问题是你说的是“可以”开枪,给人的理解这么做是合法合理。这完全是以讹传讹。美国法律讲究的是reasonable response。 也就是说,如果一个reasonable person在屋主的情况下,是不是感觉到trespass的人是不是会对他造成bodily harm。 不是你说我害怕对方伤害我就可以的,陪审团会把他们放在同样情况下,来做一个reasonable person会做的决定。 楼主说的这个故事和一个邻居无意踩上草坪是完全不一样的情况。
