事情到了这一地步,双方剑拔弩张。 老板一家也不是普通华人。段然当时28岁,3岁时随父母移民美国。而他的父亲段小毅曾是国内知名男高音歌唱家。这家餐馆就是段小毅开的,后来才交给儿子段然打理。在和埃德尔曼发生“电邮大战”时,四川饭庄已经开了18年,在当地积累了一定的人脉。有老顾客甚至愿意寄给哈佛副教授100美元来平息这件事。

埃德尔曼的所谓正义感,并没有得到哈佛的普遍认同。一些哈佛商学院学生甚至为中餐馆发起募捐,为了证明商学院的学生不是“只在乎钱,只在乎自己的事业,不关心他人”。 为什么这么说呢?因为这不是埃德尔曼第一次这么做了! 早在2010年,埃德尔曼也和一家寿司店进行“电邮大战”,为了自己所谓的权益据理力争。最终,寿司店对埃德尔曼下了永久逐客令。

2015年,埃德尔曼申请哈佛大学终身教职时,有两件发生在2014年的事引起了哈佛内部审查委员会的注意。 除了中餐馆事件,埃德尔曼2014年在博客上揭秘线上广告公司Blinkx的弹窗广告具有欺骗性,此举引发了Blinkx的抵制,埃德尔曼认定BLinkx雇了公关来诽谤他的声誉。 因为他在2014年的两次举动都引发了不小争议,哈佛决定将他申请终身教职的决定推迟两年。 到了2017年,埃德尔曼继续申请终身教职,哈佛内部审查委员会收到了12条同事有关埃德尔曼的匿名投诉。 为了做出平衡,哈佛给了埃德尔曼一个下马威——必须获得商学院超过2/3的教授投票才能通过。但此前,商学院选终身教职并不一定需要投票表决。最终,埃德尔曼只获得了58%的教授投票而错失终身教职资格。
而被他死磕的“四川饭庄”,反而因祸得福,不仅得了“免费广告”,在埃德尔曼落选哈佛终身教职的2017年还入选为《绅士杂志》(Esquire)年度全美最佳酒吧之一。段然本人也上了GQ杂志。
有报道称埃德尔曼和阿联酋航空“死磕”。原来,他2019年12月在美国预订了2020年11月从西雅图飞往阿联酋迪拜的机票。埃德尔曼当时用阿联酋航空积攒的积分为妻子和两个儿子(2019年12月时年龄分别为4岁和7个月)支付了机票费用,从而获得了阿联酋商业奖励的席位。 因为新冠疫情暴发,阿联酋航空取消了2020年11月西雅图飞迪拜的航班。新冠疫情过后,埃德尔曼一家准备2022年飞往迪拜,但是小儿子已经满3岁,飞机上需要给他独立的座位。阿联酋航空就让埃德尔曼给小儿子补差价。埃德尔曼当然不乐意,和航空公司展开了漫长的拉锯战。

奇怪这些学生不把自己当消费者,自动替资本家站台?我觉得他跟企业公司餐馆斗争,是有利与消费者的啊,要不然这些餐馆乱收费,消费者就应该息事宁人默默忍受?
暗戳戳的多收费,反而是受害方?这个教授这么大的名气和执拗都没有治住乱收费,还被打压?华人餐馆乱收费我自己都经历过好几次,有一次甚至多收一倍,欺客就是欺客,难道是小商家就可以欺客?客的钱也不是大风刮来的。

因为任何事情都有个度,开始是正确的,纠结过度就好像bully了,好比一个孩子看到另一个孩子被欺负,仗义执言是对的,之后还告诉老师也是对的,跑去教育欺负人的孩子也算ok吧,天天都义正严辞的教育那个欺负人的小孩子就有点变味了,感觉就是变相bully, 旁边人受不了也是人之常情。
有必要,4美金虽小,但是也是欺骗。 骗4美元没事,那下次就8美元,然后16, 32, 64, 128?他这么骗,每一个顾客都多收,早就远远高于4元的骗款了。这是欺客的店遇到了硬骨头,才被曝光了。没有这个刺头儿,不知道多少人要被多收费。

教授懂法,对当地法律很了解,又执拗较真,感觉就是为了纠正商家这种小欺小骗的风气,所以坚持要依法办事。
商家也很精,觉得如果退12元,就自己承认违法了,遇到这种刺头儿,刺头儿很可能不仅为自己追钱,还有可能帮其他顾客追回来,所以商家就干脆抵死不认账。
不只是退回他一个人三倍差价,而是要求退回给所有的客户三倍差价。小business有疏忽难免,因为一个小错误就把人搞垮了有意思吗?况且商家也小字说了价格会变动,这个人就是打官司也赢不了的,只不过小business一般没有财力跟他闹。你可以说商家没有信用,不去消费,但是商家并没有犯法。这个人盯着小business这样搞就是恃强凌弱。你看那些大公司根本不理他,人家法律资源雄厚就当他是noise。
所以 那家餐館 好不好吃?
这个哈佛的新规定一定是学校和系里头头不太喜欢这个人,私底下讨论了多次, 找一个比较合适的借口拒绝了他。不过看样子做的是对的,这个人不好相处。

既然出错了,赔偿所有因为这个错误而有损失的顾客有什么不对吗?
严格意义上说人家并没有出错,只是没有update网站而已,而且网站上也写了价格可能变动。他家是按照纸质的updated menu收的钱,以教授一贯的行为有可能是付钱时已发现这个inconsistency, 却在事后写Email很傲慢地威胁别人。如果他真的很占理觉得他能告赢中餐馆他也不会那时候道歉了。
没有及时update导致价格差异还不叫出错?那干脆菜单上所有菜都随便写个数字,然后收钱的时候也是随便收个数,之间没准差价几百刀,然后只需要小字写上没有及时update就好了,这逻辑,也只有这种搞鬼的商家才会赞同吧?
另一方面,既然发现了错误,顾客要求赔偿有什么不合理?要求赔偿所有受损失的顾客有什么不合理?

理论上商家可以这样,只要你order时接受了信用卡签字了就行。但是这样的商家很快就不会有顾客了,对他长远没有好处。但这种行为并不犯法,这是两回事。
