If only happened once, most likely was from overflow of the
bathtub, where there may be leak from the overflow drain to the tub drain. It could happen again when the upstair have overflow again. For the damage, it's hard to get upstair owner to pay. If it's too high, above your deduction when you have insurance, you can try to have your insuarance company to go after theirs. But upstair need to fix the problem if proven to be their bathtub leaking. They will need access from your ceiling to the bathtub.
我在波士顿有个condo出租,和租客从未有过问题。请教大家的问题是屋顶漏水的问题。我的condo在一楼,今年三月份房客报告洗手间房顶漏水,房客拍了录像像瀑布一样。我找了property management的emmergency检查了一下,漏水已停,检查人员也没找到原因。漏的水全在浴缸里没造成其他损害。我要求management修屋顶,他们一直说是我的responsibility去找楼上的人。我认为我也不知道这水是从哪里来的,不能直接楼上打官司,而且我的insurance也不一定管这事。
这事应该怎么处理,找BBB还是上court?这么点的官司律师也不一定接。谢谢大家关注。
这个事情和BBB有个狗关系。
好多年前,修理抽水马桶的漏水,没有水箱,用手柄按一下就抽水的马桶。cutoff的阀门,是坏的,我也不懂,转几圈就以为关掉水源了,结果扭开阀门盖,水就像黄石公园的喷泉一样涌出。我住六楼,马上让家人叫大楼管理员关总水阀,就几分钟,消防车也来了。结果是楼下的5楼损失惨重,4楼就是墙有点水迹。
后来类似的洗脸盆水溢出,甚至浴缸放水溢出都发生过,还好都是自己的楼上楼下。
所以,漏水许多是疏忽大意,但房客不会承认,特别是“瀑布”般漏水,如果找不到管子损坏,极有可能是人为因素。
Association是不是应该负责任。
打开天花板不一定能看到问题,因为浴缸没有放满水是不会漏的。
