最近安装新的围栏,把survey 拿出来看了一下,发现邻居的车道和车库占了我们家6英尺宽的地面,房子去年买的。买的时候前房主的fence就是和邻居家的车道是无空隙的。并且FENCE边的一棵树被邻居家以围栏为界限砍掉了一半,当时以为分界线就在围栏这里。现在才发现其实我们这边围栏向邻居方向6英尺都是属于我们的地,但是看来他们的车道和车库都修建了几十年了。计算了一下,6英尺宽的地面实际面积被对方占走了840平方英尺。
求问,这6英尺宽的地还可以拿回吗?,我们是否可以让邻居移走车库,归还属于我们的面积呢?

假设车道和车库都占六尺,那么车道由于他们没有禁止你们使用,只是prescriptive easement,就是他们可以用你们的地皮,地产还是你们的。
车库占六尺就不一样了,如果车库有门有锁,完全是他们用,他们可以claim adverse possession。如果你去告他们,他们可以反告adverse possession,这样地皮就丢掉了。
但是如果车库仅仅是一个carport,没有门锁,那么还是和车道一样,是prescriptive easement,地皮是你们的,他们可以用。
看样子似乎NY的年限是十年,不知道房子历史是什么样的。你要知道更多,传照片上来。
首先买房律师没有看土地勘探文件。可以和对方协商,然后通过律师达成一个协议,不行就走法律程序。这地面积也太大了, 不能轻易放弃, 否则你以后卖房会吃亏的。
