eviction - lockout 问柠檬和其他大侠

我赢了一个eviction case in Nov, 21。 经过holiday hold，终于警察安排了lock out day， 这周四 1-20-22。房客通过town 里的tenant lawyer filed a paper asking the court for a preliminary injunction and permanent injunction to prevent the lockout。 满篇的瞎话，说没有出庭是因为没收到法院发的notice，也没收到 property notice 和  judgement of possision。

问题是周一是holiday，房客这是还可以得到 court order to prevent the lockout 吗？

 

 

 

 

我是用来律师的，而且做了很多作业。程序不可能出错。房客律师等最后两天来捣乱，

也是有目的的。这个房客找不到地方搬。

你的整个程序是律师走的？那律师应该有通知送达的证明，比如请sheriff.. 我们这边

Demand and eviction notices房东可以自己送贴门上照相日期。

但立案后的传票得房东去sheriff office请人送。

法庭没收到sheriff officer的回执之前不会安排上庭时间。

现在一般推荐律师搞。纽约州19年之后，弄得非常复杂

对，政府拿宪法没办法，就只能从别处捣蛋了。简单的驱逐也增加了很多小的方面不利于房东。比如

我们这边，一般给完规定付款日（7日），房客再要付款，房东可接受或不接受随意。

现在是：法庭支持房东和房客在立案前，7日后可再有机会调解付款。

所以现在做驱逐，都要做足功课，免得掉坑里了……

我们这里送出庭的notice是法院直接寄

我在NJ。律师把关程序。但房客说没收到法院的信，因为是两家shared mailbox。

Sheriff 已经安排了lockout， 还有两个working day，法院也不会不要证据就issue stay 吧？

is the injunction granted?

疫情期间万事皆无不可能。我1月4日赶房客，警察上门了房客没有任何准备，也是说没收到lock out 的notice。我看了下文件

房客胡搞，法官没批就没问题

我们这儿，不出庭就自动输了。法院通知是城管送的，法庭不承认是不可能判案的。你的律师怎么说？

1／20以前不是还有两天上班吗？

eviction 到这个时候千万小心， 不要为省钱自己去贴告示什么的， 我们州发生了几起杀人事件

去， 也要把警察叫上， peace maker
