请柠檬和有经验的给把关这个closing statement

 有个房客三代在一个房子里住了四年。今年靠工伤死去亲人的赔赏金买了房子搬出去。感觉西裔的第二代比第一代难打交道很多。这个第二代是专业PM,好在我平时也是一切按规矩办事,四年相安无大事。可是他们搬走房子搞得很脏,我看在他们住了四年的份上也没打算跟他们争执清洁费。可是walk through 时,他们坚决不同意付任何damage,说不是他们搞坏的,还威胁任何扣任何押金就去法庭。你们看照片这是正常磨损吗?我不想搞得法庭去,但也不想让他们太嚣张。所以不想给他们一项一项Argue的机会, 就把total number减了50%。 请大家看看下面statement有漏洞吗?

Damages: total of items below is $ 570.00, conditional* reduced to $ 285.00

Kitchen Floor damages  (This floor was brand new when resident moved in) -repair cost $720, after depreciation and price reduction to tenant - $360.00 Living room’s window glass broke, double glass panel, inside glass broke: $120.00 For the 3rd bedroom, damaged door jam and changed to a keyed lock from bedroom lock -  $ 55.00 Missing light cover in the laundry room - $35.00

conditional* means If any party decides to resolve any disagreement regarding this closing statement, the Landlord will eliminate the discounted charge, and will charge the original fees listed.

By redeeming this check, you, xxxx, certifies you agree with the terms of this final statement and have no further disagreement with the Landlord. The lease contract between you and the landlord has ended without dispute.

看了照片,我觉得不算wear and tear. 我觉得第一条可以改一下,就事论事,简洁一些。以最后上法庭的态度写这些条款。

并且不要discount,找到contractor 估价后,按照那个价格扣钱。最后结果,就是法院判你输了,你也要找人修房子不是?如果你赢了,就更不吃亏了。我会这样改一改。当然,看看柠檬怎么说。这是我的两分钱。

a. kitchen floor damage, repair cost $xxxx (要是上庭,准备收据,要是就是给房客看,invoice. 不要mention新的旧的,折旧等等。把问题复杂化,)

b. broken glass in living room , repair cost $

c. damaged door jam , repair cost $

d. replace the unauthorized keyed lock with xxx lock , cost $.. (我猜想你说的是他把你的lock换了。是吗?关键把原来的分两个写清楚。)

e. missing ceiling lamp cover , cost $xxx.

房客签合同时,我付一个 "minimum charge" list 让他们签。 搬出时, 如需修理打扫,都charge 比那个

如需修理打扫,都charge 比那个list 少。

入住前,要做check in list。

你的策略应该是,一开始扣960,

他们来找你磨,最后磨到480。你不能一开始就扣480,钱出去就拿不回来了。
