谷爱凌现象
这些天大家都在看冬奥会，而冬奥会上最热门的话题是谷爱凌得冠了。因为谷爱凌国籍问题引起了很多争议，所以跟着大家一起八卦了一下。
按照她在中国是中国人，在美国是美国人的自述，以及综合其他信息，个人觉得比较接近真实版本的是她持有中国绿卡，并以中国绿卡身份代表中国参赛。其实她具体是哪国国籍并不重要，既然能代表中国参赛，就说明她既符合国际奥委会和滑协的有关章程，也符合中美两国的有关规定。而她做出代表中国参赛，是她自己根据自己情况做出的认为最符合自己利益的决定，合理合法应该是毫无疑问的。当然这个决定也许会让某些人心里不舒服，但这决定对自己有利也没有伤害他人。而且那些反对的人，如果换位思考，处在她的位置也未必不会做出跟她一样的决定。所以与其胡乱猜测，八卦有钱人，道德绑架，甚至指责，不如大家一起跟着看电视，享受她的比赛更实在。我想绝大多数华人也是乐意看到她夺冠的。
其实看过去，也有不少类似的例子，大坂直美代表日本, 美国篮球运动员代表其他国家参赛，也没引起这么多争议。谷爱凌之所以在中美引起如此大的关注，主要还是对现实中美关系大环境的一个折射。中美之间的贸易之争，意识形态的差异，COVID-19的影响，人权问题等等，不仅造成了国家层面上的对立，也在民间造成很多不良影响，所以才会有不少在美亚裔无端受到歧视，受到怀疑调查，甚至受到人身攻击。也有了今天美国主流媒体对谷爱凌的这种热议现象。当然作为平头老百姓，国家层面的事咱管不了，但因为这种对立给我们带来的影响是深远的，而且是长期的。今天是谷爱凌，明天可能就是王爱凌，今天是体育，明天可能就是科研，甚至就在街头。所以作为受到负面影响的海外华人，其实是一个整体。那么怎样作为一个整体去减少这种负面影响，而不是各说各话，互相指责，或者撇清关系，这才是真正值得海外华人去深思的地方。
办不上台面的事。如果可以允许有少量双国籍就给大家一个标准怎么样的人可以去申请。我们当然生气，多少同胞父母重病（还没到病危程度，因为国籍回不了国进不了孝。有些为此也再也没看到父母。

奥委会需要提供护照的。谷代表中国参加比赛说明她持有中国护照。但她好像也没有退出美籍哈。一个人同时持有中美两国护照，而全世界都知道中国不承认双重国籍，请问这个是不是违反中国国籍法的做法？
美国也有绿卡说，但美国绿卡持有者是不肯能持有美国护照的。绿卡和入籍是两码事。
她的确是优秀的运动员，但一码归一码。

第一是自然公民（可能不是法律术语）和归化公民的区别。谷生于美国，她的citizenship是granted。她可以不去claim，但是随时可以claim。而归化为美国公民的外国人需要通过自己申请，缴费，宣誓效忠美国。又因为中国大陆不承认双重国籍，所以如果规划外国的华人想回复中国籍必须放弃外国籍。美国允许多重国籍如果另外的国籍是被granted。比如说你的出生国允许你保留国籍，或者美国公民与外国人结婚而被granted配偶的国籍。觉得印度的做法不错。印度人加入美国籍后印度给他们永久居民身份，来去自由，不需要签证。

但中国是不允许的。中国在处理双重国籍的问题是不管你是出生在哪里，有没有自然获得外国国籍，一旦加入中国籍就必须放弃外国籍。
我朋友的孩子美国出生，18岁以前在国内。那时是没问题的，但他去年来美国读书的时候已经年满18，必须选择国籍，如果不选择就不让出国。后来孩子办理了放弃中国籍的手续，来了美国。
所以谷的行为就是违反中国国籍法。至于说她是不是特殊人才，走没走特殊通道。就算是特殊人才，国家也该有相关的透明的政策。暗箱炒作肯定不对。
删除了“她放弃美国国籍加入中国国籍”，改成了“她选择为中国参赛”。
所以国籍的事很明显了。根本没有放弃美国国籍，而是暗箱操作了中美两本护照。
至于她到底有没有加入中国籍我持怀疑态度。可能就是有本中国护照。
这个你认为无可厚非的小姑娘在说谎，她的团队的宣传是毅然放弃美国国籍--可事实没有，她在说谎谋利，要知道这个“毅然放弃”是你说的那个点-国家层面的对立意识形态对立下小粉红们的高潮所在，所以她绝不是无可厚非，而是懂得高潮所在，懂得获大利所在点，见利忘义东食西宿投机谋利；第二个问题关键是：中国国籍法不允许双重国籍，中领馆撒谎说是绿卡永久居留，可是现在护照副本已经证明中领馆说谎，那么谁违反的中国国籍法，是谷爱岭！她为了投机获利不惜违反一国法律，不惜以身试法，不惜法律存在。不是罪犯也是后面允许她这么做的力量的同谋！她何来的道德，何来的没有伤害别人，她伤害了所有没有得到这样待遇的守法的人，也伤害千千万万守法至今没有可以有特权同时拥有中国护照回国去贪玩老父老母的每一个海外华人！在身边微信上几乎绝大多数的海外华人不耻恶心她的夺冠！不要代表海外华人！
