我在著名医学中心做实验室工作。从2019 年8月到 2020年4月以FMLA休病假,用光所有假期,实验室在前四个月付我大部分工资,然后我退出实验室,无收入4个月,五月转入同系另外一个办公室。
病因是严重抑郁症,我多年单身母亲,工资工作悬于一线,吓的我几乎自杀。
现在基本上病好了,开始工作,女儿的儿童抚养费终止了,我现在一个人养她,外加车贷房贷,工资完全用完实际上还不够。
昨天部门HR 要求我退还我病假前4个月 $9200 块,我不知道工资居然可以退还,想知道这方面的法律依据。

不知道你为什么休了八个月,还有四个月是付工资的。
即使你攒了四个月的病假和假期,那么后四个月为什么让你休了四个月(FMLA只有12周,大约三个月,是不付工资的。)
所以不清楚他们的逻辑,无法给建议。

你的标题写的是前雇主,可是实际上你还是在这个单位工作,仅仅是换了一个办公室/实验室,所以现在还是给一个雇主打工。
要是你离职了,他们基本上追不到你:要钱没有要命有一条。但是你还在这里工作,你不积极回应他们会扣除你一部分工资。
你去问HR能不能分一年26个paycheck还清,要不就两年52个paycheck还清,还能怎么样呢?
问你HR关于short term disability insurance的事。

入职的时候HR搞错少扣了退休金, 错了好几年, 后来通知我补交, 同时也给了选择, 可以申请waiver, 因为不是我的错误。 最后批准了。希望这个信息对你有用
