有一个在加州的出租屋的、紧邻车库墙壁的一小条地目前被邻居占着。
历史:
据邻居讲,很多(>>20)年前,前前屋主在建木围栏时,没有沿着边界线建围栏。
前屋主继承了现状。
20多年前,我们购置时也继承了现状。
10多年前,与邻居共同出资,把木围栏换成水泥空心砖,维持了现状。
现在的问题是:
1. 车库靠近邻居的墙壁有漏水/滲水的情况。
2. 想要评估一下加建ADU的可能性。
3. 想要评估一下Rezoning成MultiFamily后(这块地可以),建5U公寓的投资回报率。
最理想的状况是把原本属于我这边的这一小条地拿回来。
请问各位地主有何好建议?多谢!

如果想要回来,找出合理理由,做足准备工作。以前我有个出租屋也是邻居修fence占过来一点点,大约一尺多宽,使我这边的车道变窄了。因为已经十几年,怕麻烦就没去要,后来那个房子卖了。

第一,仅仅是占有N年,title不是他们的。他们要通过adverse possession,必须去法院裁定。也就是说,他们不去法院,他们就改不了地契上面的描述,也就是改不了title。
第二,如果纠纷闹到法院,需要法院裁定adverse possession,那么要看法律条文。

(3)你说以前和他一起换过边界栏杆,以后打起官司来,你可以说这个possession不是hostile,而是经过你允许的,证据就是你和他一起换过栏杆。就这么一条他就不能adverse possession。
(5)你这个邻居,起码付税还是按照现有的title付的,起码在名义上没有给这一小片地付税。因为他的房契在县里面的注册,并没有包括这一小片地,所以县里没有给这一小片地向他收税。所以根据这一条也不能adverse possession。
另外,根据(4)你这个房产万一过户给别人,这五年期限又要重新算。所以如果你不想解决问题,也可以卖给别人让别人去和邻居掐架。买卖还是算那一小片地是你的,因为邻居没有去法院正式占那一片地。
