下周四上小额法庭,房客消失6个月后今天忽然联系我要deposit,押金是$2700. 她实际欠了我$16215房租。

她交钥匙那天我问她新地址,她说会给我发短信,可是从她搬走以后,我电话,短信,邮件,都是从来不回复。 所以我根本无法联系到她,更不用说退押金。

她应该符合"rental relief program" 最后仅仅差她上传一个ID,一个签字。政府的人联系她,她也不回复。她就是不想让我拿到钱。 她一拍屁股走了。 我小额法庭告他,私家侦探懂了'aprove of service " for court day. 

小额法庭7号周四上庭, 她今天email 联系我,让我退押金。 她欠我19个月房租$16215。 

我在北加州,按照规定,我要退她押金吗?

請問一下,6個月都聯係不到她,怎麽file small claim的呢,怎麽遞送法律文件?

即然已经要上法庭了,就让法庭裁决呗,她可能根本不会去法庭。

查查你们州。我记得是半年之后押金没法退就自动归房东了。

不对,寄到最后一个地址,就是出租房地址。房客有可能有邮局forward service

是,寄到最后的地址是一道程序。说的是在这之后,无任何反应的,半年后租客就没法追了。

前房客不服eviction判决上小额法庭告1万。因无知没准备证明材料和庭上申辩,虽赢但判归还押金。提醒做个准备。

SECURITY DEPOSIT-California

All or any portion of the security deposit may be used, as reasonably necessary, to: (i) cure Tenant's default in payment of Rent (which includes Late Charges, NSF fees or other sums due); (ii) repair damage, excluding ordinary wear and tear, caused by Tenant or by a guest, invitee or licensee of Tenant; (iii) clean Premises, if necessary, upon termination of the tenancy; and (iv) replace or return personal property or appurtenances. SECURITY DEPOSIT SHALL NOT BE USED BY TENANT IN LIEU OF PAYMENT OF LAST MONTH'S RENT. If all or any portion of the security deposit is used during the tenancy, Tenant agrees to reinstate the total security deposit within five days after written notice is delivered to Tenant. Within 21 days after Tenant vacates the Premises, Landlord shall: (1) furnish Tenant an itemized statement indicating the amount of any security deposit received and the basis for its disposition and supporting documentation as required by California Civil Code ? 1950.5(g); and (2) return any remaining portion of the security deposit to Tenant.
