一房客这个月28号合同到期,按合同提前30多天问他们要不要续租。说不续租了,已经找到新的去处了,要搬家。我们说可以,但他们一直不交这个月的房租,昨天text问他们交房租,结果说这是最后一个月,要搬家了,所以不交了。我们说还是要交,deposit会按州法律按时根据房子情况退还。结果就不回信息了。我们现在有必要开始期待驱逐程序吗?一方面不想这么做。他们在这个房子住了2年,虽然基本每次都迟交房租,但也都交了房租,没有不交。所以不想到最后给他们来个驱逐。但另一方面,我们很担心他们合同到期不离开,因为我们这里租房市场特别紧张,很难租到房子。我们已经找到了新的租客3月分搬入。这家贵人如果赖着不走,我们就麻烦了。 我当时决定要提前找房客也是因为他们告诉我们,已经找好下家了,不续租了。但后来才发现,他们其实还没有找到新的去处。所以担心他们不走。请有经验的投坛大佬们给点建议。先谢过了。

法律上为了保险你要给一个notice of termination,亲自送上门,最好递给房客,或者贴在门上。里面措辞是什麽,可以参照网上样本.
至于security deposit能不能抵消unpaid rent,要看本州法律,有些地方还真不能直接抵消。所以必要的话,还要贴一个notice to evict for nonpayment of rent.
