请教专家:买房close后发现社区安全隐患问题

各位大佬好,小弟的房子(湾区)于2021年12月29日close了。房子是在街角,有一面没邻居。在loan close前两天(12月27日),我发现fence被人涂鸦了,然后我的agent代表我给原房主写信,询问涂鸦问题和该社区的安全问题。对方agent在loan close前回复如下:

1. Is this graffitied often : the  seller said no it hasn’t  . Also for your reference they have not lived there for the last 4 months and no graffiti has occur until this incident.   结果搬进房子后,跟邻居聊天,得知fence以前也被涂鸦过。 2. For your reference the seller also  informed me and wanted me to inform your client he has also lived in this property for the last 20 years and the seller stated that no criminal activity has ever occurred on his property. This is also on the sellers disclosures. 这一条是关于社区安全问题。原房主说“no criminal activity”. 结果多个邻居告诉我们这个房子一年前刚被break in。 我现在有被骗的感觉。请问小弟现在应该怎么办?能要求赔偿吗?多谢各位大佬。

这个要请柠檬大侠来解答,我的理解是seller应该disclose。你查一下房子以前的保险就知道有没有break in了

where in seller's disclosure?

California real estate disclosure mandates disclosure of crimes result in death and those related to sex offenders.  There is no general requirement to disclose criminal activities.  

The agent says ". For your reference the seller also  informed me and wanted me to inform your client he has also lived in this property for the last 20 years and the seller stated that no criminal activity has ever occurred on his property. This is also on the sellers disclosures."

You need to find the sellers disclosure and find out what they said.  Even if it is not mandated, as long as seller lied (on paper), you can sue him.

我的印象中好像disclosure里也没有要求这一条。好区坏区买前就应该弄清楚,不是难事,buyer需要自己做due dilig

你查查警察局的记录。实在不行跑一趟当地警局,他们会有最近一个礼拜一个月等的各种犯罪记录。

好像印象里只disclosure Lead 和 房子近12个月住不住人,没item 选 crime. 这个在买房时买主或

realtor 自己的事,跟卖主没关系吧。
