I'm currently working on purchase loan with Bank of America for an investment propety. My closing date for the property has been extended two times, but BofA still failing to finish the closing document for me to sign. Now, the sellers agent is threating to cancel the contract. Since this a 1031 exchange, I'm going suffering substantial damage(EMD plus tax loss) if the deal does not go through. Does anyone have similar experience? I'm thining to find a lawyer to help. What type of lawyer shall I hire? restate lawyer, or other? Thanks

She only started to work on everything at the last minute. Most recent issue(today) is about reserve. I provided my life insurance's cash value as reserve. It's under review. Mainly, it takes too long to move every single step in BofA. To close on time, today is last day to sign, but it's too late now. No time to work with other lenders now.

居然嫌弃我房子多,嫌麻烦,拖着。后来只好取消,重新找别家办。
先说一下我知道的情况。这段时间,银行预约估价师所需时间大大延长,特别是在市场很热门的地方,单是估值一项可能耗时2-4周甚至更长。若此为银行无法掌控的事态,打官司胜算多少,你自己先估捏一下。
我听起来卖家只是说要取消,但还没有真取消,是么?若是,那么现在当务之急是解决问题,咽不下的气也等事态无法挽回之后再出。找卖家谈!先感谢对方非常大度延期了两次。然后,表示你愿意加价多少(1-2%或多少数目,看你自己如何评估这个物业)以对卖家做补偿。别大谈银行如何不力,提一下即可,表示对银行的理解可能更能取得卖方的认同感(因为事实上你现在需要卖家是有同情心和理解事态的人)。假如运气好卖家同意了,价加这部分钱,你心中不平也可以找银行讨个说法。
另外,若45天期限还没过,下其它有任何可能性的offer,死马当成活马医。
非常理解你的心情,我也身处其中,知道拿到offer多么不容易,在这种市场里做1031需要承受多大的压力。

我以前也是一定要找利息好的。现在都是找可靠的,特别是以前用过,关键时候能有关系帮我加快速度的。利息稍微差一点无所谓,反正以后也能重贷。 买房的过程中未知的事情太多,有一个可靠的团队,包括lender, 比省一点手续费重要的多。
所以到目前为止还没遇到做不下来的loan,最差的时候无法是打电话给糊涂的processor骂她一顿也就行了
他们的commitment letter 左催又催总算出了,按以往经验,我们就开始安排过户了。但我们的律师一听是BOA,马上说你最好问清楚他们可以过户了吗。一问,居然说起码还要一个月以上才有可能,害的我们只好准备现金过户。
