A 20-year-old man arrested in connection with the alleged assault of a flight attendant onboard a cross-country American Airlines flight last week — an incident that sent the crew member to a hospital with broken bones in her face — made his first court appearance Monday.
Brian Hsu, 20, of Irvine, Calif., is charged by a criminal complaint with interference with a flight crew and assault within the special aircraft jurisdiction of the United States, according to the U.S. attorney’s office for Colorado.
Hsu offered a different account of what took place.
He said he had gotten up to use the restroom and was standing and stretching when he accidentally bumped the flight attendant with his hand or arm. He said the flight attendant became agitated and began swinging at his head with her hands.
He said he was especially concerned because he was returning home to California after undergoing brain surgery in Rhode Island to reconstruct portions of his skull, according to the affidavit. He said he received the injury after being assaulted sometime during fall 2020 while in New York. As a result, he said, he continues to suffer psychological damage, ringing in his ears, nausea, dizziness and loss of balance.
He also told investigators he was sensitive to sound and sometimes experiences a mental “fog,” which can make it difficult to think, the affidavit said. Hsu told investigators any impact to his head could cause him “severe injury or death,” the affidavit said.
Hsu said after the initial encounter, he backed up and raised his hands with his palms facing outward in a defensive manner. But, he said, the flight attendant charged him and hit her nose against the palm of his right hand. Hsu said he did not see blood, but recalled that a male flight attendant intervened, pushing Hsu backward and restraining him, the affidavit said. He recalled that after he returned to his seat, other people “restrained his legs with brown tape and his hands with plastic cuffs.”
Hsu also told investigators it would have been impossible for him to hit the flight attendant with his fist because he was injured playing football weeks earlier and was unable to clench his hand.
Hsu’s mother, who was not identified in court papers, said her son had suffered a brain injury and as a result “seems to become more easily angered,” the affidavit said. She said after his most recent surgery, he was having trouble sitting and frequently needed to stand and stretch. She said her son was stretching when he hit the flight attendant but the flight attendant then rushed toward her son, the affidavit said.
Three witnesses told authorities they saw Hsu strike the flight attendant near the airplane lavatory, with one describing a “scramble” between the two before seeing Hsu hit the victim with his fist.
