前两天有个帖子说起,查了一下

100年前,路易斯安那有个案子,就是火车分黑白车厢是不是违宪。 最高法院的判决时不违反。大法官Harlan 投了反对票,不支持这个判决,认为黑人的人权被侵犯了。所
以Harlan后来被追认为人权斗士的先驱

看看他在判决书里,作为反对派的意见

There is a race so different from our own that we do not permit those
belonging to it to become citizens of the United States. Persons belonging
to it are, with few exceptions, absolutely excluded from our country. I
allude to the Chinese race. But by the statute in question, a Chinaman can
ride in the same passenger coach with white citizens of the United States,
while citizens of the black race in Louisiana, many of whom, perhaps, risked their lives for the preservation of the Union, who are entitled, by law, to participate in the political control of the state and nation, who are not
excluded, by law or by reason of their race, from public stations of any
kind, and who have all the legal rights that belong to white citizens, are
yet declared to be criminals, liable to imprisonment, if they ride in a
public coach occupied by citizens of the white race.

华人被合法的excluded,连公民权都没有

大法官惊诧没有公民权的华人在路州居然享有比有公民权的黑人更好的待遇

这就好比发现狗居然比人都尊贵了一样

The "Oriental Exclusion Acts" had great bipartisan support. The one thing
both the left and right could historically, and today seem to still agree
upon, is that Asians are undesirable. In the terrible Plessy "separate-but-equal" supreme court decision, there was one celebrated bright spot: Judge
Harlan's dissent, called "Harlan's Great Dissent"--but even here, though
Harlan was against Black discrimination, he felt Asians were *so* alien they--of course--should be discriminated against; Harlan wrote:

"There is a race so different from our own that we do not permit those
belonging to it to become citizens of the United States. Persons belonging
to it are, with few exceptions, absolutely excluded from our country. I
allude to the Chinese race."

Today, what brings liberals and conservatives together in warm conviviality is the idea that Asians must be limited. Handshakes across the aisle: "
There are too many of them." "They are all the same." "They are not from
here." "Not real Americans."

From the right: "Kung Flu", Chinese-bashing, "The Koreans are a terrible
people", etc. From the left, bipartisan agreement--this gut feeling that: "we don't want that many Asians. There are too many of them, they're too
good at math, they drive up the curve, they set the standards so high that
there's no chance for our kids."
