The President has lawfully exercised the broad discretion granted to him under [the US Code section] to suspend the entry of aliens into the United States. By its terms, [the section on inadmissible foreigners] exudes deference to the President in every clause. American Immigration Lawyers Association (AILA) reports the May 2020 Visa Bulletin has not been cleared for release to the public. The presumption is that it is being delayed for release until after the executive order is issued.
Fox News is told the 60-day pause will apply to Green Card awardees who are currently overseas. These are people who would be coming into the country via the State Department program.
President Trump is acting properly and justifiably to temporarily suspend immigration to the U.S., former ICE acting director and Fox News contributor Tom Homan says.
This includes people awarded permanent residence under the diversity lottery, work green cards and chain migration. People who are seeking Green Cards under US Citizenship and Immigration Services (USCIS) are already in the country, so they are not subject to the pause.
