前几年lay off换工作的时候有点gap，最近准备面试的时候想捋清楚，请大家帮我看看影响大不大，应该怎么解释
5/31：老公司最后一天
6/14：Phone interview
6/28：Face to face interview
7/15：Offer
8/8：H1b receipt date
8/29：正式开始上班
有两个地方拖时间了，一个是律师准备H1b transfer材料花了三周多，二是本来拿到
H1b receipt就可以上班但新公司那边入职接待的事务出了点情况，延后了我的start
date，又白白拖了三周。
听说H1b的Grace period是2个月，我这个如果从新工作正式上班算的话已经超了，咋办？
你最后一次入境后还有gap么？如果没有的话，问题应该不大。
这就是最后一次入境后的事，后来没出过境。是不是完蛋了

H1b START DATE是指797上的批准日期？那都是第二年5月的事了。但即便是当时PP了，也是8月下旬批准，于事无补

有个什么条款(好像叫245k? 记不清了你搜搜)是说这种情况可以原谅180天
当然填485的时候承认没承认是另一个问题, 另外据说只要当时给你的H1B批件上有I-94就可以.

这个看来应该没事了 没有立刻revoke h1的话 very likely你H1又撑了一段时间 60天
应该都没有用光

一般Layoff，雇员有Package，雇主不会马上通知USCIS，那你就没有out of status，
不需要和IO说什么Gap，完全不需要担心。

这么说来，工作和status其实是两码事？比如我这种情况，employment history写两份工作的起止时间，前一个只能写到5/31，后一个只能从8/26开始，但中间那段时间只要雇主没有revoke，我的I94也没过期，status就没问题。
这么理解对么？

这个坛子天天有人问gap，但我从来没见过有谁说2-3个月的gap最后影响到绿卡了。
该吃吃，该喝喝，啥事没有
关注这个问题，几乎和楼主一样情况的gap.
没事，transfer交上去之后到批准之间可以上班，也可以不上班，都不违反status。
所以你这最多就是一周左右的status violation，没问题的。
这点时间没什么大不了的
顶多h1b不给你境内转 让你出境一次
只要你之前那个i94没过期 再多两个月都没事
工作和H1B Status有很大的关系，但不是工作一丢，H1B Status就没了。Status还和I-94的过期日期，是否有Layoff Package，公司的内部规章制度有关。
象我们公司Layoff H1B，HR会根据H1B的I-94过期日期以及Layoff Package付清日来定
Termination Date，再通知USCIS。
另外，即使真有Gap，这种累计不到180天的Gap／Violation，不影响你拿绿卡。
