An indictment said Zhai tried to set fire on the campus and it was considered a "terrorist threat." Zhai denied he tried to start a fire. Zhai's lawyer, Haiming, an American Chinese, said the university may be attempting to extract revenge on his client for his earlier comments, the report said. Zhai complained about racial discrimination at the university during a television interview and claimed that he would file a lawsuit against them, prior to the argument with the professor. "This is possibly the reason the university started trouble against him," said the lawyer, adding that his client did not deserve a criminal charge for his emotional comment during the dispute with his professor. "The US should not be a nation to convict people on words. Even if Zhai made some improper statements, he doesn't deserve such a charge," the lawyer said. However, the situation is not in Zhai's favor, the lawyer told chinesenewsnet.com because the case is complicated and involves not only the university, but also the police and the immigration department. Zhai is being held at the Hudson County Correctional Center, which is across the river from New York City, the report said. Zhai's father called the university but the university said Zhai no longer has any ties to the university, the China Business View reported. Luo Gang, the Chinese Consul General in New York, said such cases originate usually out of cultural differences, according to the China Press.

西安的王女士怎么也不会想到，正在美国留学的儿子翟田田竟被指控为“恐怖分子”，而且面临着要被递解回国的可能。昨日，记者在西安市文艺路一家属院里见到了满面憔悴的王女士，她说，自得知儿子出事以来，她已有几个晚上彻夜未眠，过着以泪洗面的日子，目前，家里已请了美国的律师为儿子辩护。
飞来横祸：儿子在美国被拘捕
5月中旬的一天，王女士突然接到来自美国的自己儿子的一位同学的电话，这位女同学在电话里说儿子翟田田已被美警方逮捕，现在被关在新泽西州的一所监狱里。
“真是晴天霹雳一样，好端端地在美国留学，怎么会被逮捕啊？”王女士说。
王女士儿子翟田田今年27岁，在西安出生长大，2003年签证到美国，被捕前在新泽西斯蒂文思技术学院（Stevens Institute of Technology）攻读物理专业博士学位。
“我就不明白，儿子是上个月出事，直到现在也没有任何机构告知我们发生了什么事，要不是那位女同学，我们到现在都还不知情。”翟田田的父亲翟泰山说，从上月中旬至今，家里一直未能与翟田田联系上，在美国的儿子“人间蒸发”了一样。
据美国的另一份报纸《多维新闻》报道，由于翟田田在美没有亲人，一直未有人知道其入狱的消息，直到本月中旬，他才以对方付费电话向中方领事馆求助，才让事件曝光。
经与美国方面多方联络，翟泰山也是最近几天才知道儿子的消息，由于通讯非常艰难，加之语言不通，翟田田被扣押一个多月来，家里还未能与他有任何的信息交流。
详情披露：与教授口角放狠话
记者昨日通过王女士联系到在美国的翟田田的同学，这位来自台湾的女同学介绍，翟田田被捕是因与他的教授发生了一次口角，教授认为翟田田在与他争吵时讲了一些有威胁性的话语。
据美国《侨报》5月20日报道，4月15日，翟田田与其教授因为学业意见不合发生口角，其间并无任何肢体冲突。但翟田田说了“大不了就拼了”之类的狠话，教授报告了校警，校警当天拘捕了翟，并将他移送给警方。
在校方的起诉书中，翟田田被控为“恐怖分子”，理由是他企图放火烧毁学校。接下来，先是学校开除了翟田田的学籍，之后移民局递解、警察抓人、检调机关起诉，一夜之间，翟田田从一个普通的中国留学生，变成了一个危害美国国家安全的“恐怖主义威胁”的犯罪嫌疑人。
“翟田田在与教授争吵时，说话是有点冲，但听他本人说，绝对没有说过要放火烧学校之类的话。”这位女同学说，翟田田在班里学习成绩一直不错，而且在班上人缘不错，大家都喜欢这个聪明的中国小伙儿，她不明白这样的同学怎么会成为“恐怖分子”。
律师表态：不可能被无罪释放
得知儿子在美国被捕后，翟泰山心急如焚，并通过翟田田在美国的同学聘请了律师。
为翟田田移民案件辩护的律师名叫海明，是位美籍华人。他在接受记者采访时表示，他也是通过电话与狱中的翟田田了解情况，他认为翟田田被控“恐怖威胁”并不合理。海明律师说，翟田田曾在不久前接受电视采访时，发表了对学校不满的言论，并声称要以种族歧视起诉校方，“这可能是学校处理他的真正原因。”
“作为一个华人，即使没有任何费用，出于中国人的良心我也愿为翟田田辩护。”海明说，“恐怖分子”在美国是重罪，如果罪名成立，翟田田将被遣返回国，也就意味着他的学业将前功尽弃。海明表示，即便这次翟田田不至于以恐怖威胁被定罪，但因执法部门担心会被反告，所以他应该也不可能被完全无罪释放，否则执法机关将面临天文数字的赔偿。海明表示，现在所能做的就是尽量争取翟田田不要被驱逐出境，获得转学的权利。
中国领馆关切事件进展
据《侨报》报道，中国驻纽约总领馆目前也正对事件进展表示关切，并希望美方能够依法处理。
《侨报》称，中国驻纽约总领馆侨务领事罗刚说以前也处理过类似的案子，中国留学生因为有不恰当的言行或文字表达，引起了冲突。他认为中美两国文化不同，一些中国人认可的言论会被美国人当成是威胁。(《华商报》供稿/图)

看来小伙对学校有不满由来已久，不止这次学分的事。当然学校方面也同样对小伙不满很久。
个人vs机构的对抗中个人本来就是弱势群体，这时更是应该谨慎对待。小伙如果一开始先下手为强，通过法律的途径起诉校方种族歧视，而不是意气用事威胁校方，结果应该也不会这样
