国内的售房款,转到美国账户,值得冒险避税吗?

我是绿卡。
1) 国内一套售价大约140万人民币(买入120万人民币), 2) 国内一套45万人民币(和买入价差不多吧) 3) 东南亚一套小房子,售价大概60万人民币,(买入价大概45万人民币)。
售房款计划转入美国账户,请教税务问题:
1.因为买入价和售出价相差不大,税是不是不多? 我是老老实实交税还是想办法避税?
2. 是否可以把售房款打入我朋友的国内银行账户,让朋友每年以礼物的名义转5万美金到美国的银行账户,这样可以避税吗?

如果持有超过1年,增值部分才交15% or 20%的稅, 不值得冒险。

楼主这些房产以前每年报税的时候都申报过吗?如果没申报过,会不会有罚款?

房产不需要报税吧 只有金融资产才需要 比如银行存款股票退休金等

再找两个朋友的名额,包括自己的名额。用每年5万*3个名额的额度汇,大概3年时间即可。

Does foreign real estate need to be reported on Form 8938?   Foreign real estate is not a specified foreign financial asset required to be reported on Form 8938. For example, a personal residence or a rental property does not have to be reported.
If the real estate is held through a foreign entity, such as a corporation, partnership, trust or estate, then the interest in the entity is a specified foreign financial asset that is reported on Form 8938, if the total value of all your specified foreign financial assets is greater than the reporting threshold that applies to you. The value of the real estate held by the entity is taken into account in determining the value of the interest in the entity to be reported on Form 8938, but the real estate itself is not separately reported on Form 8938.

绿卡卖国内房产我印象里IRS基本不收税,就是不会国内国外收两次;如果之前没有一次性的转移过财产,钱也可以申请一次转出来,不受每年的限制。

千万不要朋友,太考验人,国内没信得过的亲人吗, 还有你国内汇过来的话,不能是你自己名字的账号吧?

你有2套房国内肯定要让你上税的,那个可以抵消你在美国的税,干嘛不报?不然查出来更吃亏,花点小钱买个安心嘛。另外国外房产不用每年申报,但是卖了要交capital gain.
