Watson said she fired her gun because she though the woman was coming at her for another attack. “She put her hands on me and she pulled my hair out and everything else. And while she was beating on me, I shot her,” Watson said in a 911 called obtained through a public records request. 商店店员在攻击者转身的一霎那开枪了。那是因为我们能看视频慢动作。在当时的场景,我觉得他是自保了。

我完整的看了视频。
首先,我们先同步下美国的枪法,只有在收到人身致命威胁时候,动枪制止威胁才是合法的。这里有几个细节:
1、所有州都同意在自身致命威胁下,动枪合法。大部分州不允许为保护财产动枪。为保护他人安全动枪是否合法,也就是citizen arrest,不同州细节规定有很多不同。 2、退让原则,也就是在遇到威胁时候,是否需要先退让,再反击,这一点部分州需要退让,部分州不需要。 3、追击原则,也就是当袭击方退让,或者中止之后,被袭击方是否有追击的权力。这一点很多州是不同的。
在这个视频中,冲突双方处于搏斗阶段,被袭击者用枪还击是没有问题的,毕竟不断击打头部已经构成致命威胁。
但是在被袭击者已经摆脱袭击,双方之间相隔1-2米,袭击者已经收拾衣服转身离开的瞬间。这时候开枪,是否合法,需要根据当地州法律来判断,我个人认为。。。有问题。
如果警方或者检察官认为,开枪时候,双方第一轮冲突已经结束,那这个案子对开枪者更加麻烦,被诉个二级谋杀不为过。
文章中的文字描述,警方和检察官的观点,跟我上面的个人判断类似,这也是开枪者被诉的原因。
我认为你在夸大其词,或者不太懂美国相关法律,基于以上理由。
这中间的法律判定跟是否用枪没关,用斧子砍过去,法律上的处理一样。拥枪的人,没必要自己给自己加受虐的戏。
这明明是一个罪犯攻击(attack)店员, 怎么就变成了打架(fight)?
关键是开枪的时间点,是否处于attack中。
从视频中,我个人得出的结论是:
attack。。。已经结束了,那个女开枪时候,第一轮attack已经结束了。
所以我才为店员可惜。就是半秒不到的差别,就要为自己的行为上庭辩护
要是那个店员骂那个罪犯一句bitch, 罪犯再次冲过来是不是就可以开枪了?!
我自己的结论就是拿到枪就开。 一想就慢了半秒他就转身了。
不适合做这样的假设,即使仅仅在网上假设。
从我个人来说,枪是保命用的,不是在argue中获得优势地位的。
不受生命威胁,不动,动了,唯一目的就是制止自己或者家人遇到的致命威胁和伤害。
