I saw property A today, the owner was trying to do 1031 exchange, owner already in escrow with property B.
There is a tenant in property A, lease until May 2023, rent is $2650 a month.
if I buy the house A, I can''''''''t move in until May 2023. unless I break the lease early with the tenant, Property A is a single family house.
The owner don''''t plan to get the tenant out before close of escrow, whoever buy the house, has to take over the lease. 
Is it worth the trouble to buy the property A and then pay the tenant 30k to buy him out?
I wait one and half years and then move in if nothing happens, but if the tenant don''''''''t want to move out in May 2023, I will have trouble.

一般情况: trouble 到不会。如tenant 是个讲理的,when the contest ends ,as long as you give them enough notice to move in alignment with the contractual language (of the lease), they no longer have legal ground to stay there . 所以,如果他们不走,你可以serve 他们eviction notice. 有好的工作, 好的credit 是不会自毁的。
但是疫情期间:
前段时间eviction protection clause 还在的时候,以上这种情况就复杂了。你还是可以要求他们走的。但是要出各种证明你要自己搬进来。还要file paper work. 政府那效率你懂的。
另外你说房子的卖家已经escrow 了自己要买的房子? 那这人应该是準備reverse 1031 了。 這個的timelines比traditional 1031 要嚴格的多。他有许多offer 吗? 也许你可以和他的agent 談判下你现在出钱让他和tenant說讓他們早move out ?
唉, 現在房市太魔幻了。sellers market. 所以最後看誰著急咯。誰談判就占上風。
Anyway , speak to your agent about this . Do you have to have this property A ? also try to consult a rental market lawyer about this ?
