我们收入差距很大,去年异地一年所以队友按head of household报的,结果歪打正着,所有的stimulus check他都收到了

报 HOH 是不对的。。。。。。。去年我一个朋友就是因为这个公民被拒了

跟风问个问题,2019 收入家庭 收入 14万, 但是2020年收入30+万,这种情况下还能收到600吗?

HOH要未婚或者已婚但法律上分居的。然后在满足其他条件。你们这种已婚两地的要么按join in marriage,要么 分开按single报。找个CPA给你们改一下吧。

我的理解是即使没有离婚,但是满足以下条件也是可以considered unmarried,这种状况大多在离婚之前存在 (比如双方已经不住一起超过6个月,一方带孩子生活并负担50%+生活费),夫妻因为工作或者其它原因两地分居的应该不能算,因为还是两个人一起负担家用的。

irs写的很清楚 只要符合以下几点之一就是必须filemarried 第3点就是夫妻分居两地: You are considered married if any of the following are true: You are married and living together. 不过一般离婚的前奏是分居,一般不打算离婚的夫妻很少not live with you anytime during the last 6 months of the year吧,而且另一方都不怎么负担家用,当然也许有特殊情况。

这个irs好像查得比较严。很容易招来审计。那就要出示法律文件表示分居正在离婚进行中。你们是打算离婚吗?

可以负责任的说,已婚,不以离婚为目的的分居是很难符合HOH的要求的。你如果是按HOH报了,最好file adjusted return。如果你们的return在audit的时候被认为是fruad。就不只是利息加罚款那么简单了。

也没有什么不对,只要符合规定,有小孩,小孩和你在一起生活的,特别是准备离婚的,就可以按HOH报。

是的. 这个exception 适用于离婚进行时的人 我那个朋友报了好多年 HOH, 老公报 MFS,但两人没有打算离婚。 公民审查时,老公批过了,老婆没过。 拒的原因就是 tax return fraud。 现在找 CPA 报过去 5 年的 tax return amendment,还在进行时。

华人大妈都这么有钱,找个CPA很难吗?这些东西与其自己觉得是怎么样的,不如咨询一下专业人士。为了省点钱,惹IRS实在是最划不来的事。得不偿失。关于税的问题和身份的问题,真心觉得不值得省钱,找CPA和律师比较稳妥,不要因小失大。

华人大妈都这么有钱,找个CPA很难吗?这些东西与其自己觉得是怎么样的,不如咨询一下专业人士。为了省点钱,惹IRS实在是最划不来的事。得不偿失。关于税的问题和身份的问题,真心觉得不值得省钱,找CPA和律师比较稳妥,不要因小失大。
