In order to establish eligibility, the petitioner must establish that: 1)The beneficiary qualifies for the requested classification; and 2)An exemption from the requirement of a job offer, and thus of a labor certification, is the national interest of the United States. USCIS has designated Matter of Dhanasar, 26&..........Under Dhanasar, USCIS may grant a national interest waiver as a matter of discretion if the petitioner demonstrates by a preponderance of the evidence that: 1) The beneficiary's proposed endeavor has both substantial merit and national importance; 2) The beneficiary is well-positioned to advance the proposed endeavor; and 3) On balance, it would be beneficial to the United States to waive the requirements of a job offer and thus of a labor certification. If these three elements are satisfied, USCIS may approve the national interest waiver as a matter of discretion. Others include whether he/she has shown a record of success in his/her previous work, his/her progress towards achieving his/her proposed endeavor, and the levels of interest in his/her endeavor from relevant individuals. Therefore, please submit evidence to establish that the petitioner is well- positioned to advance the proposed endeavor. 加州北区联邦检察官安德森(David L. Anderson)与联邦调查局(FBI)旧金山分局特别探员班尼特(John Bennett)联合宣布,中国籍访问学者宋辰(Song Chen,音译)隐瞒身为解放军现役成员的事实,已遭签证诈骗刑事罪名起诉。
宋辰20日上午在加州北区联邦法院首度出庭,审亚裔联邦法官莎莉‧金(SallieKim)负责审理。如果定罪,她面临10年以上徒刑及25万元罚款。
根据联邦检察官提控书,38岁的宋辰2018年12月23日持J-1非移民签证入境美国。J-1签证是为从事学术交流计画的外国访问学者提供,宋辰是在2018年11月递交签证申请。
联邦检察官指出,宋辰在签证申请书上写着,她曾在中国军方服役,期间为2000年9月1日至2011年6月30日,现任雇主为“西钓鱼台医院”,地址为“北京市阜成路30号,邮政编码100142”。宋辰描述她的职业为神经科医师,到美国是为了在史丹福大学(Stanford University)研究脑部疾病。
提控书中指出,宋辰在签证申请时提供的资料,全为谎言,她入境美国时仍为解放军现役成员,填写的雇主资料只是做为身分掩护。
根据联邦检察官调查,宋辰提供给史丹福大学的履历表上,列举了她与其他学者联名发表的研究报告,但透过网络公开数据库搜查显示,宋辰与解放军空军旗下组织关系密切,而她在签证申请表上填写的工作地点,地址其实就是解放军空军总医院。
检方持法院搜索令搜查宋辰的外接硬盘,发现她在今年6月21日删除、中文名称为“2018访问学校重要资讯”的档案夹,其中包括她写给中国驻纽约领事馆的信函。
宋辰在信中解释在美国的研究计画需要延期一年,并写道北京“西钓鱼台医院”只是用来办签证的幌子,必须透过解放军空军及第四军医大学办理手续才行,并称军方核发的文件属于机密资料,无法透过网络传送。
