疫情期间辞职,notice怎么给

我和老公都是essential worker。疫情期间一直坚持工作。但是家里有小娃儿,我们俩还需要用自己的PTO轮番在家看娃儿。现在俩人的PTO已经用光了,但是疫情还看不到头。 所以决定抓大放小,我辞职在家一段时间。因为我的工资低,而且相对好再就业。 我的问题是,我的合同里面写着,离职时需要给一个月的notice。如果我不给notice直接当天走人,会不会有法律责任?主要是条件实在不允许给notice,我们俩人都没有PTO可以再用了。 补充一下,我在的是小公司。如果我长期休假,老板肯定要再顾人顶替我。而且没有任何的福利,我是contractor。

re, 如果老板想留你,肯定会帮你想办法,让你能够照顾孩子。 如果老板不想留你,或者实在没办法,知道你的情况,也会找一个合适的办法让你尽快辞职。

怎么都比你什么都不干,不问老板,却来问网友,想立刻resign该怎么办?

我这个月用了 Leave for covid-19 famialy act , 70%工资,我问了州里劳动局,他们回答公司不能强迫我回去上班,如果我不愿意,也不会丢掉工作。 我孩子15岁,条例规定18岁以下学校关闭的都可以。 我主要监督孩子上网课写作业时远离手机。在学校上课是所有小孩手机放教师门口的挂袋里面。家里得监督。

lz醒醒吧,contractor哪要给什么notice啊,礼貌点的话,直接打个电话说一下今天就是我的last day,要不然直接邮件说一下就行了。 老板辞退你的时候,可没有这么讲究,见过吃午饭的时候,告诉你,今天就是你的last day的,然后就没有然后了,这就是contractor

family first act 貌似需要在公司工作了一年以上,不是什么公司都可以有

family必须是500人以上的公司,而且工作一年以上,不是什么公司都可以有

These provisions will apply from the effective date through December 31, 2020. Generally, the Act provides that employees of covered employers are eligible for:
Two weeks (up to 80 hours) of paid sick leave at the employee’s regular rate of pay where the employee is unable to work because the employee is quarantined (pursuant to Federal, State, or local government order or advice of a health care provider), and/or experiencing COVID-19 symptoms and seeking a medical diagnosis; or
Two weeks (up to 80 hours) of paid sick leave at two-thirds the employee’s regular rate of pay because the employee is unable to work because of a bona fide need to care for an individual subject to quarantine (pursuant to Federal, State, or local government order or advice of a health care provider), or to care for a child (under 18 years of age) whose school or child care provider is closed or unavailable for reasons related to COVID-19, and/or the employee is experiencing a substantially similar condition as specified by the Secretary of Health and Human Services, in consultation with the Secretaries of the Treasury and Labor; and
Up to an additional 10 weeks of paid expanded family and medical leave at two-thirds the employee’s regular rate of pay where an employee, who has been employed for at least 30 calendar days, is unable to work due to a bona fide need for leave to care for a child whose school or child care provider is closed or unavailable for reasons related to COVID-19.
Covered Employers: The paid sick leave and expanded family and medical leave provisions of the FFCRA apply to certain public employers, and private employers with fewer than 500 employees.[1] Most employees of the federal government are covered by Title II of the Family and Medical Leave Act, which was not amended by this Act, and are therefore not covered by the expanded family and medical leave provisions of the FFCRA. However, federal employees covered by Title II of the Family and Medical Leave Act are covered by the paid sick leave provision. Small businesses with fewer than 50 employees may qualify for exemption from the requirement to provide leave due to school closings or child care unavailability if the leave requirements would jeopardize the viability of the business as a going concern. 你这个人真是顽固! 好像貌似是什么词? 你自己都说不清楚怎么回事, 然后叫一个已经给出美国劳工部门的link还copy and paste相关内容了的人再去查?! 没听过“谁主张, 谁举证”? 如果你坚持是要工作一年以上, 那么你要扔相关政府部门的link 和内容prove你的认知是正确的, 懂吗?

要不要离职或者请假都不评论, 单说15岁的孩子还要监督上网课写作业是不是有点那什么, 这么大的孩子还让你监督吗?

你是contractor随时可以走啊。我很久以前有个老外同事是contractor,有一天推着自行车出门,就再也不回来上班了,听老板说他辞职不干了。

Depends on your company. My company modified the policy and anybody can apply for it if needed since COVID-19 happened.
Better to consult with HR...

但是楼主的合同里居然有1个月notice 既然合同写了还是跟老板商量吧 正式工合同也没有看见过这种 都是at will啊

LOA要真的有病 拿醫生開的證明才行啊~ 不然屬於 insurance fraud 雖然疫情期間可能沒有auditor 來訪  但是聽說過有的人骗LOA結果被auditor 逮到在趴踢 結果被起訴的。 並且給你開證明的醫生license 也可能被取消。什麼醫生會這麼好 給人亂開LOA啊 除了自家親戚朋友
