没有绿卡的人卖房子一定要交capital gain?

卖房律师说因为夫妻双方有一方没有绿卡,所以title company要扣留15%的钱用作以后交税用(多退少补)。是这样吗?我以为primary resident home有$250k的exemption,按根据律师所言,好像没有绿卡就没有这$250k的exemption? 我当然也相信律师一般说的也是真的,但是还是有些疑惑,所以看其他人有没有类似情况,谢谢!

最后交的税是一样的 但是没绿卡要withhold 而且标准不是按绿卡 而是是不是resident(就是在美国住满5年)

我妈拿到绿卡之前卖了一套投资的小condo. 最后报税交的钱和resident 是一样的只是 卖完拿钱的时候他们会预先withhold税钱,怕你跑路了不交税. 自住房的$250k非绿卡也一样享受的

这个时候看irs官网解析才是最权威的:https://www.irs.gov/taxtopics/tc701 然后看一下publication 523看你的eligibility requirement detail. 目前看来你需要qualify 2个test:ownership test和use test ownership test:If you owned the home for at least 24 months (2 years) out of the last 5 years leading up to the date of sale (date of the closing), you meet the ownership requirement. For a married couple filing jointly, only one spouse has to meet the ownership requirement. use test/ residence test: If you owned the home and used it as your residence for at least 24 months of the previous 5 years, you meet the residence requirement. The 24 months of residence can fall anywhere within the 5-year period, and it doesn't have to be a single block of time. All that is required is a total of 24 months (730 days) of residence during the 5-year period. Unlike the ownership requirement, each spouse must meet the residence requirement individually for a married couple filing jointly to get the full exclusion.

跟有无绿卡没关,都要交,只是听说没有绿卡要交的更多。绿卡公民5年内自住3年不需要交。

谢谢大家的回复,最后根据律师的建议,为了避免以后税收上的麻烦,把房子转到我一个人的名下(过程不复杂,就是填张表),然后卖掉。
