请问国外房产是否需要在美国报税

看到隔壁帖子提到国内存款利息和IRS。
刚搬到美国的小白请教:

我和先生都非美国人,持工作签证在美国,无绿卡。国内有房产,目前无政府记录在案的出租记录。

在银行开户时声明过国内有房。请问房产算收入吗?需要全球报税吗?

当然不需要!

理论上有租金收入就要报。光持有房产不用申报。卖掉之后的capital gain 要报。

Tax resident 不一定需要绿卡。持工作签证在这里工作的都是tax resident, 在报税上和绿卡公民没区别。

不需要,如果那房产不是来自美国resource。
Nonresident aliens are those who are legally present in the U.S. but do not have green cards, such as tourists. Nonresident aliens are only required to pay income tax on any income that is earned or otherwise realized from a U.S. source. They do not have to pay tax on any foreign-earned income

不需要,如果那房产不是来自美国resource。
Nonresident aliens are those who are legally present in the U.S. but do not have green cards, such as tourists. Nonresident aliens are only required to pay income tax on any income that is earned or otherwise realized from a U.S. source. They do not have to pay tax on any foreign-earned income

读了resident Alien 的定义,我们应该属于Nonresident Alien.所以应该和你说的一致。境外收入(不来自于美国)不需要抱税。

以后父母老了国内的房产转过来也要交税?那可都是父母国内赚钱买的

如果你在美国居住少于183天就不用申报,没有租住记录不等于不算居住时间。反之则要claim income,同时可以deducte费用。

转:If your foreign source income is taxable in the United States will depend on if you are considered a resident or nonresident alien for United States Federal tax purposes.

Because most people on H-1B visas need to be present in the United States for the majority of the year to meet their job requirements, most will meet the presence requirements of the substantial presence test in the first or second year they are here.  Therefore, most individuals on H-1B's will be considered resident aliens in their first or second year in the United States

If you are considered a resident alien for United States tax purposes, you will be required to file a Federal income tax return (and a state return if required by your state).  You will be taxes on all income from all source (both foreign and domestic). This means you will have to include all capital gains from all sources on your tax return.

所以2017看你居住时间决定,2018要claim国内外income。
