互联网才最近10年的事情,所以破案率大大增加。“白银案”排查了6万人,后来通过远亲血液就破案了。这个就是很大的突破。大城市你报案,当地派出所警察就马上上门询问案件情况,进行分析情况了,就开始排查了。你以后回国去派出所可以多多了解一下,现在加上二代身份证有指纹信息,所以更加方便了。美国能够为了一个案子大规模排查几万人,不可能,身份id也没有指纹、更加没有户口,更加没有居委会。

开始大家说一般成年人走失不会马上立案。你甩个国内未成年人相关的法律。
我说那是关于未成年人的规定,成年人马上立案是要证明那个人无民事行为能力或者真的是走失真的被伤害。你就甩一个公安部领导说没有法律规定成年人走失不马上立案的新闻。
我说那个新闻里点出了“家属在报正常成年人失踪时警察根据情况决定是否立案”,跟我前面讲的是一样的。国内走失也没有全部天天上新闻马上都立案的。很多成年人走失很久别人才发现。你就回复我“走失家人就是包含成年人”,还举例了居委会。我说“走失家人不包含成年人”了?你甩的新闻上说的清楚“家属在报正常成年人失踪时警察根据情况决定是否立案”。没说“家属报案立马立案”吧?还有,好像zyy这件事没有居委会周围的人努力似的。再说,居委会和立案有关系?

有些人看了几部电视剧,键盘一敲,就当自己比fbi还厉害了。 这些人别兴奋过头,反而把事情弄糟了,倒霉的是受害人的家庭。
你真的不太懂国内司法系统。。。我知道的也很少。但是我至少知道国内户口还没有完全联网。查户口这种事有权限设置,每一级能看到的资料不同。办案跟户警也没关系。真的。办案的警察也可以看那些内容的。。。。不需要户警参与办案。
美国公务员没有中国效率高真是大家都知道的尝试。但是。。。国内警察也有很多规矩,不能随随便便去别人家里直接搜。。你想太多了。国内并没有你想的那么落后。的确有一些人以权谋私,但是这种情况下警察肯定按照规章制度办事。这就和疑罪从无的制度一样。有时候确实放过一些坏人、但是也保护了很多好人。大家都对这些政策有自己看法,单不能说这些规章制度全错全对。

马上推测什么证据不足也是玩mind game。大家保持关注肯定是必要的,但是不能轻信没经验的人,这个是很严肃的命案。

现在除了尽快地找到yingying之外(第一个时间点是14号下次上庭之前),我觉得华人可以在法律的范畴之内另辟蹊径,看看能不能在心理上对其造成攻势,让他崩溃。我能想到的,例如,在某次出庭之时,找一些(一个)年龄身材发型和yingying类似的女生,穿上yingying失踪时的衣服,戴上一样的眼镜,出席听证,静静地看着他,观察他的反应。外国人不是对亚洲人脸盲么?口号就是:今天我们都是yingying.
但不同意楼主对陪审员构成的说法。怎么去掉不想要的陪审团成员对律师来说是一个非常技术的活。有的律师请要请专业律师来帮助完成这一环节,甚至邀请心理专家参与。
如果检察官不够有经验,是应该花点钱雇人的。

这里对陪审员的选择陈述的确过于简单了,仅仅是出于达到通俗易懂的目的。事实上,挑选陪审员是非常非常关键的一步,对很多律师都是一个很大的挑战,太考水平了!实际操作非常复杂,都无法三言两语表达清楚的。

就近解决的可能性更大。可以双管齐下。
我没说过人肉,我说的是要制造舆论,让媒体和大众了解章mm的案子,以此达到同情章mm的目的。我也说了三点,1、大规模地毯找人 2、找舆论,让人们多多关注案件。别的mm说找PR,这个主意很好。3、登报找寻目击章mm无论是人还是body的线索。我不知道你认为这三点有什么错误。前面一个相似的案件也是有1000个人去找,也开了facebook等网络媒体去找人。最后通过几个方法,那个案件的受害者找到了,嫌疑犯判了三个终身监禁。
估计他不是和我们同一个中国來的
大家不认同你的是关于中美警察对比,你没听说过雷洋案?山东辱母案?并没有说国内不好的意思,只是不同的司法体系都有各自优劣,过于biased的评论在这里并不能达到效果。
我也是最后一次和你说,国内是有冤假错案,我们学习刑法的时候,老师也会教授什么样的罪犯适用什么样的量刑。你说的两个案子已经很后面了,我们当时最著名的是马加爵案件。从大环境来说,大城市的警察效率确实很高,当地派出所民警和街道和居委会是一直联动合作的。在基层挂职锻炼好几个月,国内的民警依靠街道是非常重要的一个环节。
而且我的初衷就是希望有舆论PR,无论是游行还是媒体,这个只是形式,重要的是能够找到章mm的下落,多个人知道就多一份力量。我不希望不发声音。这个就是初衷。
“那你告诉我18辆车需要花3天才去查好吗?每天6辆车的速度去查?FBI效率高吗?如果华人能够做的恬不知耻,FBI在最初的黄金72小时找到或者控制住犯罪嫌疑人,章mm还有生还可能,犯罪报告中写了嫌疑人3天内洗了2次车,那说明最初的72小时章mm有很大可能活着。恬不知耻能够救人的话厚脸皮根本无所谓。这个和党不党没关系,是和华人在美国的地位有关系。你根本没搞懂。反正这里亚裔都是软柿子,容易被欺负,你换个黑人或者墨墨试试看,华人那套软弱在这里行不通。光靠马丁路德金的演讲,没有黑人自己的斗争运动,黑皮现在在美国算个屁。”

你从第一页说到快20页,每次都不回答问题还转移话题。到最后开始举例论证“中国警察效率高”。事实上中国政府某些时候办事效率全球第一没错。但是刑事破案率的话中国貌似没有美国高。哪怕中国刑事破案率高,你最后一直在拿居委会论证“中国警察有用,美国警察没用”岂不是自己打自己的前面说的话的脸?这次FBI至少在不到一月内找到了凶手并且逮捕审判了。你越证明FBI无能岂不是越说明这次超常发挥没有歧视亚洲人?
