关于老教授被Bully,主要问题是

What his Chair has been doing to him is,though well within her authority,unethical and unfair. The questions are: Can he fight the unfairness? Is there a chance for him to win? Is there a tool such as Title IV or any other law or regulation protect him from being treated unfairly? Or the only thing he can do is to take the loss and move on with a ruined reputation?

找来学校的ethical standards 或者civil behavior statements, 在collective

bargaining agreement 里面查找departmental chair 的 responsibilities , 根据那些条款,看他是否违章。再有去学校的 social equity office 进行compliant,根据其中的条款,看系主任行为是否属于骚扰范畴。关键是,要找到他违反的规章制度条款,才能有 case。 说实话,人生苦短,如果不是因为他必需完成目前在做的研究项目,退休未必是个坏事。先请一个学期的病假,看看不上班是不是更好?

你说的那么笼统,没人知道怎么不 fair了,如果说,别人的schedule 好于他的,

这个不算unfair。因为是从需要进行的安排。如果说,别人都是教9 个学分,而他必需教12 个,那是unfair。你给的都是结论,不是fact,没人可以回答你的问题。bullying 到处都有,这个只能采用行政手段,不是法律。

unfair 是个模糊概念,bullying 界限不清晰,但,如果是因为年龄歧视被 discriminated against

可以用学校提供的法律服务得到帮助,如果有工会,工会有律师,在他们的帮助下决定如何进行。当然也可以雇佣私人律师。

if he truly likes research and still has grants,

he can retire  and keep part of his lab to work. He will  mostly use his own retirement money and the payment from school will be reduced. If he does not have external grant support, it usually will not work. It is time for him to retire.

前面已经写了,教授不想被迫退休。在公立大学工作通常工资不是问题。如果工作35年,很多地方的退休金每年至少是

最高工资(五年平均)的百分之七八十。再加上社保(如果70岁开始拿社保,社保会很高),总共很有可能都超过现在的工资。

问题是如果现在有实验室,退休后可能自己就没有control了。如果是被迫,会不会还给留office?

那就不退休啊,扛着。他都是tenured full professor,学校不能轻易解雇他。看来学校没有工会?不行了找律师。

这个正常。老三届。恢复高考时都三十来岁了。读完大学来美国读博,加上可能还要做博士后或临时教课两三年,二十年又过去了。

实际上是为了保持他的职位系主任没办法的办法吧!估计他没grant或者grant只能cover他工资的很少一部分.通常州里拨款的工资标准很低,老教授现在拿到的工资应该比州里拨款给的工资高. 加新课是为了让低年资的教授们看到虽然老教授科研能力不够还可以教学。这实际上是在帮他维持reputation!看到好几个这种例子。如果实在不想退,拿个RO1再看看?
