以 DC,MD , VA 三個區域為例,前面二者對於成年子女收養基本上沒有特別的規定,但是 VA 就比較麻煩。
原則上,你的先生可以向當地法院提出要求收養的要求,然後走程序。你的孩子與你基本上是被動,因為只有你的先生有這個權力提出申請。不過有一個問題是如果你還有其他未成年子女,那麼他的生父除非已經過世,否則你們必須取得生父正式書面的同意,放棄對孩子的監護權。(這種情況,不是你離婚再嫁就可以完全由您獨立決定,甚至於就算是你與生父沒有婚姻關係,仍然需要生父的同意)
如果你這樣做的原因希望是將來在您現在的先生過世之後,您的子女們能夠與您先生的其它他的婚生子女有一樣的權力,可以繼承他的財產,那麼與其這麼做,不如由他立遺囑將一部份財產指定由你的子女來繼承,或許簡單一些。

這個部份,必須熟悉你所在地區法律條文的當地律師來幫助您。
老貓的同事過去就有過這種麻煩,生父出獄之後要爭取監護權,(出生證明上沒有他,但是生父找律師取得法院命令做親子鑑定),最後還好是用錢擺平。
(D)遺囑的部份,這是你們的家務事, 不關老貓的事。
其實,如果不是有迫切的原因,真的不需要這樣麻煩,等孩子成年之後,由他自己與繼父來申請"被領養",可以省下許多麻煩。因為成年人就不需要要求生父母, Termination of parental rights,所以你的先生應該可以相當簡單的領養已經成年的孩子。
