请教大家。城建部门发建筑证失职,如何讨个说法

2013 年, Building permit was issued to my home without asking flood certification.  The builder finalized the house and we moved in without knowledge.   Now we found out my home is in special flood zone and required to buy very expensive flood insurance.   We could move the location of the house out of flood zone if we knew it.  We have 5 acre land.

The flood zone is there since 1990.  Building department admitted their negligence.   Building deparment is also local FEMA flood agent.  We were quoted to revise flood elevation certificate which will cost $50000.  

The builder is not available anymore.  He passed away and his company was dissolved 5 years ago.

So, the only responsible party is City Building Department.  City personel told us that they won't do anything.  She hinted that City won't do anything unless there is court order.

We don't know what to do?  We find out this issue in Feb 2020.

我的问题是,这个问题为什么现在2020才发现,你以前的保险为什么没有发现flood zone 的问题。

我也纳闷。。。不过早发现晚发现也没区别。楼主可能应该请律师打官司。

有一个情况叫做estoppel

如果一方knew or should have known这个问题,那么拖延办理不利于自己维权。

要是现金买房子,可以不买保险吧?

我们这里新房子的房顶地基之类的15年warranty,大东西像空调之类10年,小东小西5年,一般新房5年懒得shopping around new insurance。

不过要是跟我较真火灾天灾,或者花大钱省小钱之类,我承认错误。

很多房子建在flooding zone上,不一定会被水淹,就是房屋保险贵。

where to file?  which court to file for government county negligence?  If I hire an attorney, is the government county will help to pay attorney fee?

保险要多少钱,乘上20年,能有多少钱?

$1000 a year, x 20 years, that's just $20K, enough to feed a lawyer for 100 hours. 

I would not bother too much.

等我真需要的时候,不是有的不cover,就是有的算下来的价格用我的deducible就足够了,左右还是我出钱。

去年好容易有个大项目,希望他们换一下被冰雹打过的屋顶,遭到百般刁难,快气死了,今年就不买了。

不是钱多钱少,而是花得开不开心。保险公司就是打着保险的旗号,惹人生气的。

你买的那家公司的?我们第一个房子也是说冰雹,我们都看不出哪有损坏,反正Allstate给了一大笔钱,把屋顶和siding全换了。

I don't think you will have much luck with the city as the city will probably claim their approval was based on your architect or engineer's design...

I don't think you will have much luck suing the architect or engineer, either because of the statute of limitations, after all the permit was issued in 2013 > 7 years.

洪水險超貴,不知道你銀行會不會接受私人的,那就便宜很多,我以前都買當時不到一千

前兩年銀行說不接受私人洪水險了,估價5千多,我就付清了貸款,如果你的銀行接受的話短信給我,我找我那家給你
