出租房停电,租客要求报销旅馆费用

这个情况怎么处理呀?我应该报销全部旅馆费用吗?还是prorate房租,按照租客搬出的天数来算?

租客的rental insurance付,就是租客签约搬进来前续约你要强迫租客买。

HOA也不是你能控制的,他们可以找HOA赔。

我不是电力专家,不知道变电器是属于HOA还是属于电力公司。所以责任上我不太清楚应该谁赔,但是总不是你赔。

做房东,就要有点手腕,踢皮球的能力还是需要有的。

这种情况应该属房东保险付吧?我的理解是,租客保险保“租客的过失或天灾”,两边都挨不上。

我的理解是,若是全部报销旅馆费,就不退还租金,若不报销旅馆费,就按比例退回一周的租金。你若报销了,也要找人报销,

理论上你是找HOA报销,HOA找电力公司报销。

以前比较好办,直接找你的保险公司赔loss of rents,保险公司去找“元凶”,现在的情况是保险公司很凶你不敢找,就只能提枪上马自己亲自上阵了。

旅馆包括餐费是指遇到天灾(风火水),不是指任何时候。保险公司也归分责任,房子停电不属“天灾”,属“人祸”,过失方负担责任

我现在被夹在了租客和HOA之间。还没问自己landlord保险。但

估计不能报,因为不是我的fault.  To show a goodwill, I am willing to cover some cost. Just not sure if the renters actually appreciate it, as they just keep complaining. I can be tough on them if I have to. It feels wrong though for me to cover all the cost.

landlord保险会赔偿这损失,就看你认为值不值得。这事也不复杂:房客有权告你,你有权告HOA,HOA有权告电力公司。

谁不服都可以告,房客告你最容易,小额法庭。

你若想得宽点,任何一方都可能觉得自己没过错,自己是无辜的。

房客没错,你没错,HOA肯定也不希望发生这样的事(正常执行的维修责任,并付费给电力公司)。至于为何拖了一周,电力公司跟HOA的合同怎么签的,具体发生了什么,我们也不知道,不好做评。

这种事,除了真告了,法官审下来,才知道谁对谁错,谁该赔。

你若实在觉得委屈,也可以报保险,我估计保险也就是吃下这哑巴亏直接赔你而不去追索(比追索简单,多也不过两三千块钱吧,之后只需给你加点保费就找回来了)。

租客能告到我吗?

你的观点和柠檬律师的观点不一样哦。我在这个事中明显是无过错方。如果我不给租客报销,他们难道不应该直接告电力公司和HOA吗?

能,而且我认为告赢的可能性很大,因为没有电显然不满足居住条件,不是一天是一周。
