最近收到一个律师送来的两份邮件 (我和太太各一份)和两封挂号信(我和太太各一封)。该律师认定我们 “transfer to Trust” 是 “transfer” 给了new owner。因此,违反了HOA 的 rental cap 规定。“this rental must immediately cease” 。 “Any leasing of your property in violation of these provisions must cease within ten days.”
Once owner ship changes, previous owner should give new owner all the HOA documents. HOA charge fees to give previous owner those document. That is one of their income.
(d)Exemption of specified transfers or dispositionsWith respect to a real property loan secured by a lien on residential real property containing less than five dwelling units, including a lien on the stock allocated to a dwelling unit in a cooperative housing corporation, or on a residential manufactured home, a lender may not exercise its option pursuant to a due-on-sale clause upon— ... (8) a transfer into an inter vivos trust in which the borrower is and remains a beneficiary and which does not relate to a transfer of rights of occupancy in the property; or

你要去看HOA的文件,看看他的定义,transfer to new owner是什么。这是第一。
第二,是根据HOA的定义,狡辩原房主和trust的trustee完全一致。就是如果原房主是夫妻两个,trustee也是夫妻两个。这样还稍微有点希望。
基本无望。
第二:这个 trust 是我和太太二个人 trustee。原来的房主也是我们两个人。
但是如果你们提供trust instrument,是可以解释清楚的。实在不行让你们的estate lawyer写一封信。如果是你们DIY,那么就good luck了。
如果是Irrevocable trust,肯定是transfer,即使是revocable TRUST,因trustee可以改,hoa也可以定义它transferred
hoa approve后, 你们改了trustee的话hoa不知道怎么办。所有这个也算是transferred.
如果他们盯上这个,基本是不会松口啦。

你说得对,但是楼主或许可以参考以下法律,做一个argument。可能不是他自己可以DIY的。
背景:一般来说,如果有贷款的房主把房子的拥有权改变,贷款公司有权收回贷款。但是联邦法规定,如果是直系亲属赠与或者继承等特殊情况,贷款公司不能收回贷款,这个叫做mortgage due on sale 的exception。
其中一个exception,就是把房主从个人改成同一/二个人的living trust,mortgage公司不能recall 贷款。
