看到楼下Eric的帖子,我现在就有一个eviction case,租客是买房是带的,lease到期,我们不和她续约,她赖着不走,所以我们找了律师eviction,法庭判了她搬走,但是在十天之内她可以appeal,然后她去appeal并要求jury trial,现在等了三个月还没等到开庭日是哪天,但是租客需要每月向法庭交bond,律师费我这边已经付了4000,case在北卡charlotte。
因不是被告不交上诉期的租金就是没有补足高院需要的材料(地方庭判决)
不过,我问过律师,这种上诉即使交钱和补足材料,最后高院再安排hearing 的机率也是不到10%,因为高院审核了下地方庭的判决,没有疑点的话,就不会再纠缠下去了。
这种民事纠纷,法官听证,直接就判了。哪有钱jury trial.

带威胁搬走了。我就没出庭,等于放弃了对他的eviction。最后一个月房租等于是用security deposit抵了,我的损失是房间的damage,除了地板,其他还好不算严重,地板/地毯本身就很差了,两年前就应该换的没换,硬是撑了两年。这次我花了一天清洁换地板租出去了。我在Charlotte呆的时间一共48小时。
对方是穷人,政府应该有免费律师提供给她。这个房子租金一个月还不到一千,所以我也不着急,慢慢等吧,迟早都能赶出去的.
