6月28日傍晚,转换策略,跟房客来软的,给她们买一些Pizza等食物,希望她可以今天给钥匙,然后在屋外车内等房客搬完东西。将近10点,房客说还有内个箱子的杂物搬不完(车子也装不进),要求再过一天才交钥匙,然后让我进屋查看。确实只剩一些杂物。我同意了,然后好言请房客签一份,"Move out & Release Form"(如图),意思就是“确认她搬走了”。(贴图不知道能不能成功,主要内容如下)
MOVE-OUT. The Tenant agrees to vacate and move-out of the Leased Premises by June 28, 2023, unless already moved-out at the time of writing this Release. And deliver possession of the Leased Premises by returning the keys (and garage door opener) to Landlord.
Tenant affirmed XXX & XXX had already move out, there have not been and are not now any other persons residing at the Premises.
Landlord was authorized by Tenant to throw away any personal possessions left at the premises or property after the above said date of Move-out.
If the Tenant does not move out by the aforementioned date, the Tenant shall be in default of this Release, any and all claims, demands, liabilities, and causes of action shall remain in place.
SECURITY DEPOIST.
Landlord will furnish Tenant an itemized statement indicating the amount of any security deposit received and the basis for its disposition within 21 days after delivery of possession. The security deposit will being applied first to any damage and cleaning and then to any unpaid balances (e.g. rent, utilities). This is in accordance with California state law Civil Code § 1950.5(g).

you have to keep her junk for 30 days. I would say to avoid trouble the standard procedure is to rent a storage unit and put her stuff there. Pay 1 month storage fee and keep the receipt. This is the professional way to do it. If she wants her stuff she will have to pay you the storage fee. Or the storage company will auction off the stuff. This is what the Storage Auction TV program is all about...
I once paid 10 dollars at such auctions for a nice bedroom set and a dishwasher (the latter I sold for a 100 dollars...)

背景简述:
房客欠租,5月份 2/3,6月份整个月。6月5日,给了3 Day Notice to Pay or Move out。
6月13日,房客说愿意7月1日搬出,并分期付清Back Rent。
6月15日,跟房客商量说好6月22日搬出,第2天房客拒绝签Move out Agreement(里面包含有房客愿意分期付清BackRent的条款),但仍然答应6月22日搬出。
6月21日,房客说6月22日有事情,必须推到6月23日,商量无果,同意。当晚去出租房查看,一切照旧,没有搬家的迹象。
6月23日,房客的母亲(不在Lease Agreement上),打电话过来说,需要推到6月26日(周一),吵架无果,同意。周六、周日晚上两次去出租房查看,有Uhaul停在门口,确实有在搬家。
6月26日,房客又发来短信,说要再推一天至6月27日下午2点。(每次都有很好的借口,略过)。
6月27日上午,又要求推到傍晚,当天傍晚我去了出租房,发现大部分东西都搬走了,只剩下一些杂物。(屋内各种损坏,略过)。房客又要求推延至6月28日下午才交钥匙。

今天(6月29日)早上,房客又发来一大堆短信各种漫骂,说我是HARASSMENT, ILLEGAL, 非法逗留、不肯离开、强迫她签字等等,绝口不提“交钥匙、搬走余剩物口”。

比较缺少跟恶房客斗争的经验,请教大家,特别是柠檬兄和朽兄:
1. 这种情况下,房客签了"Move out & Release Form",我算不算已经把房子拿回来了?
2. 房客没有交钥匙,(我有一套备用钥匙),我是否可以自由进入房子了?
3. 如果房客没有来把剩下的那些物品(总量大概4-5个塑料箱子),怎样处理最好?丢掉?通知房客?放18天?

房客这么放狠话,你也只能回复,你已经损失很多,希望房客能合作,否则你不得不开始eviction 程序。我相信99%的房客不希望unlawful detainer 背在身上。
邮寄通知18天(加州)。4 没必要回复,不回复不等于默认。
不要做成半夜鸡叫。要会厚黑学。

表示房客已归还你房屋,她只是持有额外的一把钥匙,而她的物品暂时存放在你家里。
我感觉房客是真在搬家,也真需要时间,因为他们没请搬家公司,自己搬比预期的是会多出几天。
若你的目的是收回房屋,写破坏了些什么其实没多大意义,你拍照也是证据。就一两个月的押金,多的拿不到,除非他们自愿给你。我一开始的建议就是,若房客愿意补偿房租,他们愿意怎么办就按他们的提议办,你也不必真当回事。
你多做了一些事,也就做错了一些事,比如关系紧张你要送吃的,哈哈,我若是房客我可能也会感觉你并不是真关心,只是想达到某种目的。
现在的情况也不是很坏,房客只是提防你,且他们希望你退回押金。你先忽略那些骂你的话,问他们打算什么时候来搬剩下的物品。你管住情绪,在押金上稍微让点步,事情应该就能解决。
