You were the quest at the time. The rule is not to have residents occopy the quest parking for long length of time, given limited space. The "Owner" should mean the residents, not the property owners if they don't live there. You certainly can reason with the HOA and I guess they can wavier the fine in your case. Remeber the rule is there for a reason and everyone should obey. Of course there are exceptions and that what the hearing is for.

HOA hires PM to manage the property for the day-to-day issues. Of coourse some rules are stupid but you can change the rules if you can be elected as a HOA member.
我们在某个小区有一个房子,某天夜里(12月底)去同个小区看另外一个房子,在guest parking停了半个小时的车,被告知要参加hearing,原因是我们是homewowner,另外我们在今年8月份房子老房客搬出的时候把车停在车库外面的guest parking不到两小时等洗地毯的人,所以这次算是第二次violation,要求hearing。。
罚款没问题,但我的诉求是如何保证HOA是公平公正的?比如我们租客给我们拍了很多常年霸占家门口的guest parking位置的车的照片(有车牌号),我们可以在hearing上放出来吗?这个小区guest parking很少(小区一共30多户人家,guest parking一共10个左右),常年被某几个邻居占着,导致我租客的guest(比如家里的爷爷奶奶这种长辈过来拜访)都没有位置,只能去街对面的街趴。。
我知道和hoa对着来不大能赢,但是如果我这次不力争,是不是以后这个guest parking的问题不解决,我的租客偶尔紧急情况停10几分钟也要被罚了?如果不被hoa专门针对呢?可以要求hoa证明我们这次晚上停了半小时就被贴notice不是被专门针对么?

Parking violation has to be based on the HOA regulation: CC&R and bylaws. Does the regulation say what constitutes as Parking violation?
Every thing you speak has to be based on the texts from the regulation. It generally goes
The section xx.xx of the bylaw defines parking violation as ....
In the first alleged violation, I was doing ...., the section xx.xx does not apply because .....
In the second alleged violation, I was doing ...., the section xx.xx does not apply because ....
你可以提别人违规停车,但是不要控诉HOA不执行。你最好说,我看别的owner 都用guest parking很长时间没有麻烦,所以我也以为我可以用。Thank you for the reminder but I hope you can waive the fine this time.
首先,你不知道那些人是不是也收到了罚单。
第二,你激化了你和HOA的矛盾。
第三,别人犯法不等于你就可以犯法。
所谓选择性执法的抱怨是一个外行的思路。
这个别人停车的证据,你公开提出来谁的脸上也挂不住。你开会前和HOA的board member私下看一下照片,问他们是否也发了罚单。
公开辩护的时候,最好只是点到为止不要让人下不了台。board member 知道你说的是什么就可以了。

我就没见过这个小区哪次开过hoa meeting(hearing是其中一个环节)。
另外,我的房子门口就有两个guest parking车位,但是其中一个长期被邻居家占(邻居家有残疾的儿子),出于道德考虑,我们再纠结要不要和hoa指出这个邻居长期霸占的情况。。要么还是算了,不要单独指出这个邻居为好
比如你以前去报告guest parking瞎停车,那个邻居肯定收到了罚单。记恨于心,说不定都知道是你投诉的,结果天天看guest parking的位子,终于逮到你违章停车,赶紧拍照送HOA。

美国 HOA基本都是一些贪婪无耻的家伙把持, 他们想尽办法给homeowner 开罚单赚钱, 挺无耻的一群人. 不要怕, 直接对着干。他们有照片证据吗?没有的话你直接找他们要证据
