After DHS was created - as per the Homeland Security Act of 2002 - this specific function of the Attorney General was transferred to DHS Secretary. the Senate Version had “Shall” for AC-21 extensions and it was explicitly changed to “May” in the final version that was passed by Congress.

大意是AC21没有说可以无限延期，06年的一个memo把它解释成无限延期。
