我的女租客电话告知男租客家暴被法院开了禁令(restraining order), 现在男租客被禁止出入出租房, 请问如果女租客想继续留在出租房, 我的问题是:
1. 是不是可以restaining order名义终止和男租客的租约?如果解除,男方的押金(他当时分担了一半)要不要还给他?还是女方可以保留?女租客认为不需要还给男方。
2. 是不是应该解除原合同,重新和女方签署一个新合同 ?
有点担心女方的经济能力, 犹豫是不是改成monthly 合同, 但是女租客希望能延续原来的租约到明年6月。

抱歉没说清, 这俩位不是夫妻, 签约时他们自称是fiance and fiancee,而且孩子也不是男方的, 所以男方对女方没有法律上的经济义务对吗?签约时押金是各自付了一半押金。
问题是男方被法院禁止出入出租房, 男方不可能住在房子里, 所以只能和他解除租约对吗?他支付的一半押金必须还给他对吗?

It is his business why he can't live in the house.
