请教大家:学生租客提前搬出, lease上有要求租客要付一个lease break fee。

搬出时候, 房子状况还好,一些小问题,也没有charge他们, 觉得学生也不容易。lease break fee本来也不是太想扣了,可是 walk through时,学生的妈妈特别凶,大概觉得有break fee charge,口口声声说她也是有出租房的,要去court, 要她的律师告, 我要付律师费的,等等。在内华达州。请教大家,charge break fee( 没有rent 损失, 我们努力在他们搬出时找到了新租客), 违法吗? 这个lease 条例也是引用于一个正式的大的property manage company的lease 条例。在此, 先谢谢了!

 NRS 118.175  Liability of tenant.  If a tenant of real property abandons the property, the landlord shall make reasonable efforts to rent it at a fair rental. If the landlord rents the property for a term beginning before the expiration of the rental agreement pursuant to its terms or if, despite the landlord’s reasonable efforts, the landlord is unable to rent the property before the rental agreement is otherwise terminated, the former tenant is liable for any actual damages of the landlord which may result from the abandonment. If the landlord fails to make reasonable efforts to rent the property at a fair rental, the former tenant is liable for any actual damages of the landlord occurring before the landlord had reason to believe that the property was abandoned. If the tenancy is from month to month or week to week, the term of the rental agreement for this purpose is deemed to be a month or a week, as the case may be.

看看这个租约的第23款。

at Landlord's option, hold Tenant liable for any difference between the rent that would have been payable under this Nevada Lease Agreement during the balance of the unexpired term, if this Nevada Lease Agreement had continued in force, and the net rent for such period realized by Landlord by means of such reletting

这个lease里面没有break lease fee,只有追究actual damage(红字部分剪去蓝字部分)

很理解楼主说的这个妈妈挺欺负人。动不动就威胁去法庭告的,如果地主没有过错,谁怕谁?

我上个月有个房客,刚搬出去两天,就威胁我退押金,我的回答是

The lease said that landlord should refund any remaining deposit after the non refundable, unpaid bill (05/15-06/27 water and sewer), any excessive wear/tear costs in 45 days.

It’s pretty bad that the legal services of western New York couldn’t give legal advice and you better find someone else, because they couldn’t even tell you that there’s no claims for you yet. 

I’m a very fair landlord and I definitely not happy to hear some kind of threatening to small court. That is said, I will still send you a check out summary with pictures and receipt, like I always do in another 40 days
