关于提前退租

我女儿在路易斯安那州大读书,原本计划毕业后继续留校实习,所以六月的时候续租了一年公寓,租期从八月一号开始。结果她七月二十一号拿到了罗德岛一家兽医院的OFFER,它马上通知公寓OFFICE她要提前解约,得到的答复是除非找到下一个租客,否则她需要付余下的一整年的租金。女儿和他们商量看可不可以多付两个月的租金作为违约金,对方拒绝。请问按照路易斯安那州的法律来讲,这样的条款合法吗?算不算是霸王条款?我们有什么办法抗役提前解约吗?因为是大学附件的公寓多数都是学生租客,错过了时间目前不容易找得到租客,即使找到也只能在对方同意的前提下签约余下的月份。谢谢。

"Landlord’s Responsibility to Rerent in Louisiana

Louisiana state law does require landlords to take reasonable steps to rerent their unit when a tenant breaks their lease. This is referred to as the landlord’s duty to “mitigate damages”. "

I'd recommend just leave and don't bother with them.

8. MOVE-OUT. a. No move-out will release you from your remaining obligations under this Lease. When you leave, whether on or prior to the Ending Date, the Premises, including the windows, bathrooms, patios, balconies, kitchen appliances and furniture in the Bedrooms and Common Areas, must be clean and in good repair and condition. You must remove all trash and debris. You must follow any move-out instructions provided to you by us. If you do not or if the Premises or any furniture or appliances have been damaged, you will be liable for the charges listed in the Resident Handbook or any move-out notice or such other reasonable charges to complete such cleaning, repair or replacement. You have the option to be present at the move-out inspection; if you are not, you agree to accept our assessment of damages and charges when we inspect. b. If you leave any of your property in the Premises after you leave or after the Ending Date, that property is deemed to be abandoned by you and we can take such action as we desire and charge you with costs incurred to keep, sell or dispose of such property without liability to us. c. Damage to your Bedroom and its furnishings is your sole responsibility; damage to the Common Areas and its furnishings and appliances are the joint and several responsibility of all residents of the Apartment. d. All keys must be returned to us. If all keys are not returned to us, you must pay all costs to re-key the Premises.

e. If you move out permanently prior to the Ending Date, you are not released from liability under this Lease and we can apply your Security Deposit to your account. You will be responsible for monthly installments of Rent through the Ending Date. There is no early termination clause in this Lease.

如果你要是按照合同,人家就会要你付到租约结束。这种事情只能赖。

女儿一直中规中矩,她怕如果只付多两个月租金就走掉对方告她的话会留下不好的记录也担心会坏了自己的信用,我把你的话告诉她了,让她自己拿主意。再次感谢。

我当时提早毕业也是这样。房子空着就交呗。后来发现他全推给我了。一定是找到人租我的房子礼物。大的公寓房挺靠谱的。

她搬到外州去,别人一般不会追过去告。我的建议是看她的情况而说的。

别让对方知道你的新地址或者你的财产,即使法院出判决,对方也不一定能levy the lien

普通法中the breaching party 应该需要mitigate the damages。 我觉得你应该留存关于“你努力帮助寻找其他租客”的证据;即使诉你违约,但在其damage判定时因为你第一时间mitigate the damages,估计从你地方拿不到多少钱。但好像路易斯安那时大陆法系。。。
