昨天新上市了一个价格诱人的 water front lot,可直通海港和大海。看到后立刻打电话给 listing agent。
上市十几个小时已经有了7个现金offer。中介说卖方夫妇正在欧洲旅行,委托快速出售。忙了半天在卖方中介暗示下签了一个加价20%的offer,看似很有希望抢到。
今天一大早收到中介电邮,告知 listing 被取消。当地警局正式通知因fraud取消出售。原来地块上市后有人功课做的好询问到lot的真正主人。主人在zillow上看到房子被上市立刻联系中介并打电话报了警。中介zoom了卖方和真正的property owner,开始质疑销售的合法性,直至警察卷入fraud尘埃落定。中介十分抱歉,但也庆幸避免了各方的财务损失,同时说这种情况每天都在发生。
现金购买财产一般不是一定要购买title insurance。俺一定会购买title insurance ,买不到是不会给escrow打钱的。但也不是十分清楚title insurance是否可以查出fraud,用啥工具查出fraud。
地契一般是登记在county。财产主人的名字应当可以查到,应当可以核对。除此之外还有啥行之有效的办法可以防止fraud?

这个要注意。我去年卖个房子,
要CLOSE了,结果对方律师说发现有个LIEN没RELEASE。这个当初买房子的时候TITLESEARCH的时候没发现。我去找卖房子的时候原来的律师,结果他说,这个本来是应该TITLECOMPANY保的(具体保什么他没说),但是你以个人名下买了以后,转到LLC名下了,而这个转的时候没另外买TITLEINSURANCE。所以原来的那个TITLEINSURANCE就不管了。。这一点大家要特别注意。
只好再去找卖的时候的律师,找政府花了N个月。这个LIEN是政府的,付清了以后他们没去登记RELEASE(现在政府都是一堆乱七八糟的人在干活),等他们登记了发了个信过来,律师看了说不符合程式又得去找。
好歹等到正确的文件来了,交接了,中间三四个月过去了。
基本上就是让title把关。当时买房的时候会登记个人信息。中间转身有律师把关看文件。要是出错了就是title掏钱摆平。所以这保费几千块钱还是值得的。
这种情况下title insurance似乎也没有用。

这种欺诈,在交易前,title search/ exam 就无法通过,更不可能发生成功交易,与title insurance根本无关了。
