这个property management 的合同靠谱吗?为啥所有的罚款都归agent?

It is agreed Owner shall pay Agent the sum of 6% of the gross collected rents or a minimum of
$NA per unit when Premises is occupied or NA% if property has acreage. Agent is entitled to
100% of all application fees, credit check fees, NSF fees, 50% late charges, and any similar
fees. Owner agrees that Agent may charge tenants application fees, late fees, “locked-out”
service call fees, non-compliance fees and a service charge for all returned checks. These
fees shall entirely belong to Agent and compensate Agent for service fees and accounting
expenses.
6.3. Owner shall pay a fee of 30% of the first full month collected as a leasing fee to Agent to
acquire a new Tenant.
6.4. Owner shall deposit the sum of $250.00 as a reserve fund. If at any time funds are insufficient
to pay expenses, Owner will be notified and Owner shall remit funds within five days or as
soon as is necessary.
6.5. Capital improvements performed by Agent with permission from owner in excess of $5000
will be subject to a 10% of invoice fee.
6.6. Rents are collected from the 1st through the 6th of each month. Owner’s Distribution checks
and statements are processed no later than the 15th of that month and mailed or deposited.
6.7. All other Maintenance work performed will be done at $65.00 per hour.

所有合同,你都可以试着Negotiate,成不成,不一定。如果这是最好的,那就是市场价,你喜欢不喜欢,都是这价。

嗷,忘了回答,为啥所有的罚款都归agent?

因为是Agent的劳动(工作)所得。你只出了Capital,应拿到讲好的固定回报。另外50% Late Charges 是满合理的,因为你也有一定损失(租金晚到了)而得到一些补偿。

罚款多了一些但是还可以接受。但是6。5和6。7 有点读着不舒服。

6。5 如果你要换roof,换空调和暖气,换橱柜房子油漆等等,10%太多了。有这条房子维护会担心往大里走。

6。7 表明这个PM有自己的修理团队,有可能靠修理赚钱的。要当心一点。

如果选的话,我会要求把lease改成month to month,双方不满意都可随意退出没罚款。
