我查了下evication law,他要evict必须他先主动file complain to cournt 然后胜诉拿到court order才能赶我出去。 其实我lease还有不到两个月就到期了,到时候也得 搬出去,等court order 下来估计我的lease已经到期了。我现在打算,我就不搬,等 他file lawsuit,我attend the hearing为自己辩护就行?

这个东西是arguable的,除非房东有无可辩驳的证据,比如照片,多次整改通知后仍然没有行动,否则法院不会采信的。
还有上面说是因为欠房租要赶走,更扯淡了。访客按时交房租,但是房东拒绝,还会信了理由。不是人家不交,而是你不收,怎么可能构成No pay 呢?
屋里有蟑螂,着肯定原来就有,房东要证明是访客带来的,几乎不可能。
当然,还要看租约的详细条款,但是也必须符合Michigan 州的tenant-landlord 法典
,不符合的条款,自动作废。
以租客不整洁而驱逐,是很难很难的,除非有其他合法的理由。这是个很专业的法律问题。

房东的诉求太弱了,99% 输。访客可以提出赔偿要求。要个万儿八千的。
我就别说房东整个过程,通知什么的是否程序合法。即使从逻辑和法理上,访客占优势。
肮脏的访客,是房东最头疼的事,很难驱逐的。要驱逐,的有几个有限的合法条件,而且事无可置疑的理由。什么叫无可置疑?自己查资料吧。
