之后他还继续威胁当地警察，同事，还扬言要去当地幼儿园大开杀戒。
然后2010年这老兄就被抓起来告上法庭，并坐牢3年8个月，他就一直打官司打到最高法院，在2015年最高法院反转了下级法院的判决，认为Elonis的歌词受到言论自由的保护。而且出乎意料的是判决并不是传统意义上保守派和自由派的对决。判决是以7：1：1
反转判决的，多数方除了四名自由派大法官，还加上温和保守派肯尼迪，首席大法官小罗伯茨和著名保守派大将斯卡利亚。而强硬保守大法官阿利托是部分同意部分不同意，只有天天被自由派骂翻天的黑人大法官托马斯是投反对票，认为Elonis的死亡威胁歌词不受言论自由保护。
在多数意见书中，首席大法官罗伯茨，布什总统提名的保守派大法官，认定他没有主动去实施犯罪，光是说说属于他的言论自由。也就是说Elonis除了嘴上说说，并没有实施买刀买枪等犯罪动作，所以是言论自由。
说这么多并不是要支持这些煽动性歌词应该属于言论自由的保护，事实上这在社会中也是一个争议性的话题，很多rapper的歌词，比如痞子阿姆，都有许多类似犯罪行为的描述，而最高法院的判决书也正好引用了痞子阿姆的一段歌词。在美国社会，尤其是法律界，为了保护言论自由，对言论自由的容忍度是很高的，或者是认定是很宽泛的。
专门制定法律说歌词里面可以说，平时日常生活中不可以说，这就是给黑人的特别通行证，因为只有他们的rap才是动不动就说暴力内容的。
抛开是否违法不说，也不论官司赢面多大，这个歌词已经伤害了华人，而且已经有人听了这个歌去实施了对华人的攻击，那么作为华人就还应该起来喊，起来斗，看看那些黑人怎么干的，法律不裁定警察有罪黑人就必须消停了？何况我们纯粹无辜受威胁，要更理直气壮得多。
对方可以用言论自由做挡箭牌，我们起来示威抗议，难道不是同样受法律保护？
包括美国某些州星期四晚上可以打老婆就是这个道理.
因为当初被判无罪的打老婆的那个拳头够大.

而加拿大是没有言论自由的。如果你说了那些话，会被抓到监狱去。
所以开犹太人玩笑的，开黑人玩笑的，不用等苦主抗议，雇主就行动了。而轮到华人的时候，只能苦哈哈地游行。但是，所有这些里面，是没有政府行为参与的。这就是言论自由。
我们说 “保障言论自由”，这个观念是指在法律这个层级，你不会因为说了什么话而
受到来自 *公权力* 的处罚（除了鼓吹暴力诽谤恐吓等等）。但保障言论自由的观念，并不适用在规章与道德层面；也就是说，如果你说了不恰当的话，你还是有可能会遭受到来自 *私权力* 的处罚/反应/后果。
洛杉矶快艇队被卖掉的事件里，就是因为前老板说了种族歧视的话，公权力单位（警察）没有把他抓起来，因为要保障言论自由。但是私权力单位，NBA，却因为他的言论违
反内部章程而处罚他。这不是不保障言论自由，而是因为那是属于私权力行为，他想要处罚不当的言论，别人管不着。
又比如说某些服装设计师，不愿意为川普老婆服务，因为川普的 locker room talk 构成了性别歧视。警察没把他抓起来，因为要保障言论自由。
但是私权力单位（服装设计师，个人也是一种私权力）有权处罚她们想要处罚的不当言论。
