The new Proclamation President Trump signed on June 22, 2020 extends previously ordered suspension of immigrant visa issuance and entry to selected nonimmigrant visas, including H-1B, H-2B, J and L till December 31, 2020.
This Proclamation does not apply to foreign nationals currently in the U.S. Specifically,it prevents individuals with an H-1B, H-2B, J or L visa, and any foreign national accompanying them, from entering the U.S.
There are certain exceptions to this rule. Individuals who are exempt from these limitations include U.S. lawful permanent resident, U.S. citizen's spouse or child, foreign national seeking to enter the U.S. to provide temporary labor or services essential to the food supply chain, and foreign national whose entry would be in the national interest as determined by the Secretary of State and the Secretary of Homeland Security.
It is not clear exactly how the government will implement the Proclamation. At this time, we encourage clients present in the U.S. in any nonimmigrant visa classification to consult with their attorney before making plans for international travel to properly assess the risks and the possibility that they may not be allowed to re-enter the U.S.
