合同如下:After the required date and until the contigency is removed, either party can void the contract by written notice to the other party at which time, in the absence of any dispute between the seller and the purchaser, the earnst money will return to the purchaser. If a dispute exist between the buyer and the purchaser, selling broker shall not release the EMD without the written consent of both parties.

    

pavement有问题要修,就可以以inspection contigency退出.   你可以坚持pavement这个问题对你来说很重要,就是不满意.

那如果我退出,是不是我的earnst money 就拿不回了? 他们要我先交了1000, 说inspection 后再交3000. 另外,mit上有人说,这要被sue 的。是不是啊?

如果没有正当理由别人会sue你的  不过要看seller有没有精力来sue...

 如果真的高这么多,那你贷款肯定做不下来,用financial contigency就好了

比如说他死活不修, 这个可以算。 1000好像要损失但是押金不会,  你为什么会多夫呢? 是不是很多人bid啊, 还是他的价位比市场价低很多很多?

1000应该可以拿回来,就说inspection不满意。或者之后loan不要做下来,或者hoa不同意。

inspection report:
The concrete slabs adjacent to the garage door have sunken and the slab next to them has heaved due to water erosion of
sand beneath the concrete and resulting freezing expansion damage from beneath the concrete slab surfaces (see pictures
1-2, Section 3.6 of this report). These affected slabs should be replaced and new concrete installed. This is a serious
deficiency of this home and definitely not a normal maintenance item. Damage of this nature would not be expected to
be found in a normally maintained home that is only 8 years old.
The seller should pay for the removal and replacement of all of the sunken, heaved, and cracked concrete slabs. This
damage could have been avoided if the expansion cracks that have opened had been properly filled with appropriate
concrete patch material. Since they haven't, the buyers should not have to assume the lack of proper maintenance by the
seller.
I highly recommend that you have a local concrete contractor examine the damage and provide a quote for removal and
installation of new concrete. I estimate the cost of doing this around $2,000 to $3,000.
Once the damaged slabs have been replaced, I highly recommend that you have all of the remaining concrete expansion
cracks filled using a premixed epoxy based concrete patch material. This will help to maintain the concrete over a long
period of time and is what should have been done by the sellers to have prevented the current deterioration

当时agent说,有很多人bid.她要求我们出listing price. 还好,我们没有出。不然更难受。
我应该怎莫说呢? 如果我说:
after reading the inspection report, we realize there is a serious deficiency of pavement. Since we have to use the pavement every day,this deficiency is crucial to us. After considering the situation seriously, we decide wiathdraw our offer.
可以吗?

肯定可以的,胆子大一点,坚持点,肯定没问题的,反正那房子有别人等着要,seller agent不会追究的吧。

听按你所说paveway,  象是不大的问题.
可 inspection report上说的concrete slab, 这可以说是关系到foundation的问题.
地基不明不白下陷, 当然 是个非常大的concern.
谁能保证房子的其他部分不会也有类似的问题呢?
退得光明正大.
