Columbia student Mohsen Mahdawi arrested by DHS agents during naturalization interview https://www.yahoo.com/news/columbia-student-mohsen-mahdawi-arrested-210636638.html Columbia University student Mohsen Mahdawi was arrested by federal agents Monday while he was in a naturalization interview at an immigration office in Vermont. Mahdawi, a Palestinian student and green-card holder, was arrested by agents with the Department of Homeland Security (DHS) in Colchester, Vt., according to a court filing. Mahdawi was a leader in the pro-Palestinian protests last spring, making him the latest such activist targeted by the Trump administration. The first and most prominent foreign-born student demonstrator now in immigration custody, Mahmoud Khalil, also attended Columbia. “The Trump administration detained Mohsen Mahdawi in direct retaliation for his advocacy on behalf of Palestinians and because of his identity as a Palestinian. His detention is an attempt to silence those who speak out against the atrocities in Gaza. It is also unconstitutional,” attorney Luna Droubi said. The court filing said Mahdawi was targeted by a pro-Israel organization called Betar US, which said on social media that “visa holder Mohsen Mahdawi is on our deport list.” The Hill has reached out to the DHS for comment. A spokesperson for Columbia declined to comment on the case. The judge in the case has already ruled Mahdawi cannot be deported for now. The federal government is using the same legal argument against him as in other cases against international students, saying Mahdawi can be deported under a provision of immigration law that says the secretary of State can target noncitizens who have created adverse effects for the United States. A judge ruled Friday the deportation proceedings against Khalil could move forward under that justification. The federal government has been going after students it says are antisemitic and “pro-Hamas,” though advocates say they simply targeted those who have spoken out against Israel or in defense of the Palestinians. In a previous interview with “60 Minutes” regarding the protests, Mahdawi had condemned an individual who came to one and yelled “death to Jews.” “I was shocked and they walked directly to the person and they told him, ‘You don’t represent us,’” he said, adding “to be antisemitic is to be unjust, and the fight for the freedom of Palestine and the fight against antisemitism go hand in hand because a threat to justice anywhere is a threat to justice everywhere.”
The fine line for 1st Amendment/Freedom of Speech here (and I am a 1st Amendment absolutist), is that Hamas is a designated terrorist organization, and has been since 1997: https://www.state.gov/foreign-terrorist-organizations/ And while Mr. Mahdawi's right to condemn Israel, and support Palestine is within his right of speech, anything he said in support of Hamas can be interpreted as giving aid and comfort to the terrorist organization.
The speech to support China during a Sino-US war will be ''giving aid and comfort to the enemy of the United States'', and will not be protected by 1A.

Post WII, Nazi has not been a declared enemy nor terrorist group in the United States. While Nazi, Neo Nazi etc. have a sordid reputation here, they are nonetheless legal. As to why ''‘hate speech''’ is often tolerated, even protected in the US, I suggest that you read some case law history: https://undergradlawreview.blog.fordham.edu/first-amendment/hate-speech-its-protection-under-the-first-amendment-and-resisting-it-with-counterspeech/ ‘一个老外留学生在北大大规模组织示威支持藏独、新疆恐怖分子,不许新疆来的汉族学生进教室,你们觉得中国政府有权驱逐他吗?’ Any foreign person reside or travel to China is of course subject to the jurisdiction of laws in China, and punishments can include deportation, imprisonment or even death penalty. The State Department of the United States always remind US citizens of such fact when they travel internationally. There''''''''s no question in my mind that government in China is well within its right to deport said person.
