加一点,其实私人刑事案件辩护律师也是法律体系内绝对必要,理论上看正义甚至高尚的职业。千万不要从“怎么能为杀人犯辩护,一定是良心坏掉了”这个角度去评价辩护律师。
他们的职责是防止起诉者 (就是要把你自由夺走的人) 轻易达到目的。不要说我巴不得检察官能顺利达到目的,最后把坏人关起来甚至死刑。当制约检察官和警察的力量变得弱小,甚至主动让权的时候,检察官和警察的触手很快会侵犯到很多无辜的老百姓的利益。
辩护律师不能用自己的喜好,良知,和对案件的看法,来决定自己为嫌犯辩护时努力的程度。对待任何客户,包括毒贩,杀人犯,强奸犯,和真正 innocent 的人,都必须一样努力。只有任何案件他都一样地全力以赴,才能保证当他全力以赴 really matters 时 (嫌犯是被冤枉的),他全力以赴。
现在叫喊 jury nullification 的人,是在试图影响 potential jury 的判断,为 jury 筛选工作造成难度,影响审判过程的公平性。往轻了说是不理智,往重了说是不道德的
