Count Only Violations After Most Recent Lawful Admission When determining whether an applicant is eligible for the exemption, the law counts only status violations and unauthorized employment since the applicant’s most recent lawful admission. Any such violations the applicant committed during previous periods of stay in the United States are not counted. [9]
但h1b one expire 前公司file 了extension H1b two，根据240 天的rule 可以继续工作，然后期间file 了新的140 和485. 240天快结束时perm终于满一年了，根据AC21 可以续一年的H1b three，很快通过了，得以继续工作。
结果这两天告诉我们前面的H1B two被deny，造成了out of status 超过180天（ H1b one 和three 之间的gap），不能apply 245 k exemption， 并且出境用H1b回来也不会洗白，说是会看在美国的所有的记录，因为trump 有新的解释，那岂不是我们这样一辈子都拿不到 485 approval了？
但没有找到这个新解释， 官网的manual 也跟我们的理解一致。
求大神指教。

问了几个律师说法不太一致。特别是洗白的问题。
不eligible ac21. 当时新的perm 没有满一年，就是pd已经到了且没有file 485
移民官觉得不够out of control，这个我们还在appeal
那就找那个能让你留下来的律师办。

appeal h1b 2 extension? 这个如果批了就没有问题了？为什么会被拒？
appeal 中。 我们申请的理由是雇主的perm没下来无法file，
拿着旧公司的approved 140 去extend的是可以的，但是移民局这次不认可认为我们没有在一年以内file 485。 但不旧公司不愿意给跳槽的人file 485 不是很正常吗。。。。
但是我们也没有别的选择因为新的perm 没有file 超过一年所以不能申请一年extension。
