第五巡回法庭继续halt拜登政府对私企的疫苗强制令

查了一下,貌似主流媒体都没报道。
法庭上周五暂停这个强制令后要求拜登政府周一提供解释,拜登大概直接华丽丽地忽视了?毕竟拜登都直接说让私企们别管法院判决继续强制疫苗那他们还需要提供啥解释啊?嘿嘿
United States Court of Appeals for the Fifth Circuit concurs in granting the stay on Biden's vaccine mandate.
A federal appeals court on Friday (11/12) halted the Biden administration’s new COVID-19 vaccine rule for private businesses with 100 or more workers, marking a victory for a group of states and businesses that say it’s an overreach of the president’s authority.
The court issued a scathing criticism of that rule on Friday, arguing that the Occupational Safety and Health Administration does not have the authority to issue such a broad and aggressive requirement.
“The Mandate is a one-size fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces (and workers) that have more than a little bearing on workers’ varying degrees of susceptibility to the supposedly ‘grave danger’ the Mandate purports to address,” the court wrote. The three-judge panel also said that imposing the rule “grossly exceeds OSHA’s statutory authority.”

其实也没什么用吧,很多公司自己本身就想强制员工打疫苗。。。

公司自己强制可以,员工去告员工也赢不了官司,但是公司要打着是被拜登强制令逼的旗号去强制那就很大可能会输了官司,因为拜登那样做是违宪的,何况他连EO都没发,只是记者招待会上说了一嘴而已。

现在所有状告拜登强制令的案子要全部整合起来集中诉讼,目测最后会上最高法,就看那仨新进去的保守派大法官会不会叛变了。

Following a Nov. 12 decision by the U.S. Court of Appeals for the Fifth Circuit, the Occupational Safety and Health Administration says it has suspended all activities related to the implementation and enforcement mandate requiring employers with more than 100 employees to require vaccination or COVID-19 testing pending future developments in the litigation.
