今天找seller agent 做dual agent下了个offer.一切都好,加价,口头上答应了我的offer. Dual agent 给我发来合同签字。没预料到的是看到图中这一段。我们口头没讨论他拿多少commission. 我以为他的commission closed 的时候seller给他total %6. 但他图中这段似乎是要求我另外再付他2.5%.
这段文字似乎前后矛盾,看得我很困惑。有看明白的吗? 谁有类似经验? Text agent, 可能太晚了,他没回。
如果要我在原价基础上再付2 .5%,太不公平了。比用buyer agent还要多付2.5%

That's what I thought. 前半段似乎是说seller付,后半段又说我要付2.5%.

查了我过去的合同,都是那一项空白,不收buyer钱。他这是蒙我不懂,想在6%之上再赚2.5%.

Industry common practice is that 6% come out of the total price, 3% to seller agent, 3% to buyer agent.
In dual agency, the dual agent can take total 6%.
I think he added an additional 2.5% on top of the 6% he already got from the seller and want me to pay him another 2.5% out of pocket after I paid the seller the house price.

Texted him. He didn't respond. I will call him today. Contract expires today 5pm.
I think he charged me additional 2.5% because my past buyer agency agreements are all left blank at this field.
I already texted him that he did not tell me this before hand and I didn't expect that. If he expect to get another 2.5% on top of 6%, I will have to change buyer agent.

Agent replied that his contract with the seller is that he will get 2.5% from seller. It''s not me to pay 2.5%. But the contract with me still confuses me.
I asked him to remove it. He said no.
I said it should be taken cared of by his contract with the seller. Then there is no need to leave 2.5% in the contract with me. He agreed to remove it from my contract.

建议修改合同,和agent说按照你以前看见的那些合同的样子改。口头的东西没有证据

最好单独邮件再确认下(不要电话口头说),关于佣金大部分seller付,经常也会出现buyer付的情况。以双方约定形成合同为准。

又一个例子,找人打官司,请对方的律师做自己的诉讼代理人,钱没省下还对方情况两眼一抹黑

Update:
Back and forth a few times taking it off or not. Finally he said he would take it off but he did not know if his broker would approve it or not. I said I would ask an attorney to review. He told me they are 8 other offers. I expressed that I really want the house.
I called around to talk with real estate attorneys, all busy and the only available one charge at least $500 for retainer fee and a couple weeks later for appointment.
Finally I talked with another agent. He said that it is confusing but it''s common practice. Their firm would put an percentage there, too but they would add a special condition clause stating that the sole source of agents commission would come from the seller.
My dual agent finally agreed to remove it from our contract. I told him that he could keep it there and add a special clause. He said that''s ok.
Finally, I got the offer accepted !!!
I paid a lot over the listing price and my offer is the highest offer. I didn''t get any rebate from the dual agent which I didn''t intent to. I found the agent probably charged less commission from the seller to sweeten the deal even more. Added non-refundable deposit. Price guarantee for over appraisal amount.
I got the house, the seller and the agent got more money.
Talking about been beaten up by three all cash offers in a row ......

所以买房子有个独立的律师审阅合同很重要,也不贵。尤其有dual agents的情况下。

感觉一个可能是他以为你是自己不用buyer agent,这样等于他拿3% 然后你再付他2.5% 算是实际你的房价比用俩agents低0.5%? 如果是他已经拿了两份共6%的,那就没道理了 问清楚
