I think he added an additional 2.5% on top of the 6% he already got from the seller and want me to pay him another 2.5% out of pocket after I paid the seller the house price.

Agent replied that his contract with the seller is that he will get 2.5% from seller. It''s not me to pay 2.5%. But the contract with me still confuses me. I asked him to remove it. He said no. I said it should be taken cared of by his contract with the seller. Then there is no need to leave 2.5% in the contract with me. He agreed to remove it from my contract.

I called around to talk with real estate attorneys, all busy and the only available one charge at least $500 for retainer fee and a couple weeks later for appointment. Finally I talked with another agent. He said that it is confusing but it''s common practice. Their firm would put an percentage there, too but they would add a special condition clause stating that the sole source of agents commission would come from the seller. My dual agent finally agreed to remove it from our contract. I told him that he could keep it there and add a special clause. He said that''s ok. Finally, I got the offer accepted !!! I paid a lot over the listing price and my offer is the highest offer. I didn''t get any rebate from the dual agent which I didn''t intent to. I found the agent probably charged less commission from the seller to sweeten the deal even more. Added non-refundable deposit. Price guarantee for over appraisal amount.
